1. Participant Information
2. Assumption of Risk
Participation in yoga classes and related activities involves inherent risks including muscle strains, falls, aggravation of pre-existing conditions, dizziness, serious bodily injury, or death. Activities may include stretching, balancing, breathing exercises, hands-on adjustments, and indoor or outdoor sessions.
3. Off-Site and Third-Party Locations
Classes may be held at private residences, parks, beaches, community spaces, or businesses. These locations may present risks including uneven surfaces, weather conditions, outdoor terrain, wildlife, insects, or the presence of pets and other people. Mindstuff Yoga and Creativity LLC assumes no responsibility for the condition or safety of third-party locations.
4. Client-Provided Space
If classes are held at a participant’s home or property, the host represents that the space is safe and suitable for physical activity and agrees to hold harmless Mindstuff Yoga and Creativity LLC from claims arising from unsafe conditions.
5. Use of Props and Equipment
Classes may involve mats, blocks, straps, bolsters, chairs, blankets, and other supportive equipment. Improper use may result in injury. Participants agree to use all props safely and according to instructor guidance.
6. Health Representation
Participant represents they are physically fit to participate or have received medical clearance. Participants agree to inform the instructor of injuries, pregnancy, medical conditions, or limitations prior to participation.
7. Release and Waiver of Liability
Participant releases and waives any claims against Mindstuff Yoga and Creativity LLC, including its owners, instructors, contractors, employees, and representatives, for injuries or damages arising from participation, including claims based on ordinary negligence, to the fullest extent permitted under Florida law.
8. Indemnification
Participant agrees to indemnify and hold harmless Mindstuff Yoga and Creativity LLC from claims, liabilities, damages, or expenses arising from participation, use of equipment, or attendance at any class location.
9. Media Release (Optional)
I grant permission for photographs or video recordings taken during classes to be used for promotional and marketing purposes without compensation.
10. Governing Law and Severability
This agreement shall be governed by the laws of the State of Florida. If any provision is found unenforceable, the remaining provisions shall remain in effect.
11. Cancellation, Refund, and Late Arrival Policy
A. Client Cancellations
Private sessions require 24 hours’ notice. Cancellations made with less notice may be charged in full. Group classes and workshops require 24 hours’ notice for refund or credit eligibility. No-shows are non-refundable.
B. Company Cancellations
Mindstuff Yoga and Creativity LLC may cancel or reschedule due to illness, weather, unsafe conditions, or circumstances beyond reasonable control. Participants will receive a refund or class credit if the Company cancels.
C. Weather Policy
Outdoor sessions may be canceled or relocated due to rain, lightning, extreme heat, or unsafe conditions.
D. Late Arrival Policy
Participants arriving more than 10 minutes late may be denied entry for safety reasons. Session time will not be extended and missed time is non-refundable.
E. Payment Policy
Payment is due prior to or at the time of service unless otherwise agreed.
12. Acknowledgment and Signature
I have carefully read and fully understand this Release and Waiver of Liability. I understand that I am giving up substantial legal rights, including the right to sue, and I sign this agreement voluntarily.
If participant is under 18 years of age:
