Roam & Gather Terms and Conditions

Welcome to Roam and Gather!
Please read these terms and conditions (“Terms”) carefully as they contain important information about your legal right and obligations. These Terms, as may be modified and amended from time to time, sets forth the terms between:
Angela Harris d/b/a Roam and Gather (“Roam & Gather” or “we”), who provides curated tours and travel experiences (“Services” or “Tours”) through its business and online platform accessible via https://www.roamandgather.com/ (“Site”); and Any person (“you”) that accesses the Site and/or uses our Services.
Acceptance of These Terms. If you do not agree to be bound by these Terms, you may not access or use the Site and/or Services. By accessing the Site and/or use our Services, you hereby agree to these Terms and represent and warrant that:
You have read, understand, and agree to comply with and be bound by these Terms;
You are an individual at least 18 years of age or a duly organized, validly existing business, organization or other legal entity in good standing under the laws of the country in which you are established;
You are able to enter into legally binding contracts; and
You are not and have not been prevented by Roam & Gather from accessing the Site or Services.


User Sign Ups and Accounts. You may search for Services and Tours through our Site without prior registration. In order to book our Services on our Site you may be required to create an account or “sign up” (both methods collectively referred to as “User Account”) and may be required by Roam & Gather to provide additional information. The creation and continued operation of a User Account is at the sole discretion of Roam & Gather. We reserve the right to refuse to open a User Account and/or terminate a User Account without notice or liability, at our sole discretion. You must provide accurate, current and complete information to Roam & Gather and keep the information on your User Account up-to-date at all times. We will only collect and use personal information from you in accordance with our Privacy Policy, which may be found here https://www.roamandgather.com/privacy.
You are solely and exclusively responsible for any claims relating to any inaccurate, untimely or incomplete information provided by you. You are responsible for any activity on your User Account, and shall keep your login information confidential. If you are aware that any person has entered your User Account without permission or submitted information on your behalf without consent, you shall inform Roam & Gather as soon as possible. If you have already signed up for a Tour or related travel experience, you may not submit an additional booking request without Roam & Board’s express approval. You agree to not make any false or fraudulent reservation or booking on behalf of yourself or others.


Reservations on Behalf of Others. By engaging Roam & Gather on behalf of others, you agree to be the point of contact and responsible party. You are responsible for making all payments due in connection with your booking, notifying Roam & Gather of any changes or cancellations, keeping your party informed with all pertinent information, and ensuring your party’s compliance with these Terms. You further represent and warrant that you have obtained all required consents. You are responsible for verifying that any information you provide on behalf of another traveler in your party is complete and accurate. Roam & Gather will under no circumstances be liable for any errors or omissions in the information provided to Roam & Gather.


Scope of Roam & Gather’s Services. Roam & Gather provides curated travel experiences. Roam & Gather makes arrangements with accommodation providers, activity providers, hotels, restaurants, cruise lines, coach companies, transfer operators, shore excursion operators, tour and local guides, and other independent parties (“Third Party Supplier”) to provide you with some or all of the components of your Tour or Service. Third Party Suppliers may also engage the services of local operators and sub-contractors. While Roam & Gather takes all reasonable care in selecting Third Party Suppliers, Roam & Gather is unable to control Third Party Suppliers, does not supervise Third Party Suppliers and therefore cannot be responsible for their actions or omissions.
Any services provided by Third Party Suppliers are subject to the terms and conditions imposed by these Third Party Suppliers and their liability may be limited further by any tariffs, conditions of carriage, tickets and vouchers and international conventions and any other agreements that govern the provision of their services. These may entirely limit or exclude liability of the Third Party Supplier. Violation of third-party terms may also be treated as a violation of these Terms. You agree to read all additional third-party terms and conditions carefully. You agree to abide by all additional terms and restrictions, including without limitation, availability, age and occupancy requirements, pet policies, policies on children, fares and other restrictions. You agree that any violation of any such terms and/or restrictions may result in cancellation of your Tour, forfeiture of costs and expenses in connection with your Tour or Service, and being charged by Roam & Gather for any costs it incurs as a result of such violation.
Roam & Gather is not liable and will not assume responsibility for any claims, losses, damages, costs or expenses arising out of inconvenience, loss of enjoyment, upset, disappointment, distress or frustration, whether physical or mental, resulting from the act or omission of any party, including Third Party Suppliers. Roam & Gather is not liable for the acts or omissions, whether negligent or otherwise, of Third Party Suppliers or any independent contractors.


Participation and Age Requirements. Roam & Gather reserves the right to deny participation in the Tour or Services to you and any traveler that Roam and Gather, judges to be in violation of these Terms. Roam & Gather also reserves the right to deny minors on any trip at the sole discretion of Roam & Gather. Roam & Gather, in its sole discretion, may remove from the Tour or Service anyone who is in violation of these Terms or the terms of a Third Party Supplier. Any loss and costs resulting from being removed from a Tour or being declined participation in a trip is at your sole expense.
All Travelers must be 18 years of age or older to travel with Roam & Gather unless they are accompanied by an adult. If the consent of a parent, guardian or any other person is required by applicable law for any minor to travel, the accompanying adult is responsible for securing all consents, documentation, and ensuring that they and the minor(s) meet all legal requirements to travel, to enter into and depart from applicable countries and regions. Roam & Gather will not be responsible for any fees, damages, or losses incurred as a result of any failure to secure necessary consents, permits, and approvals. You accept all of the Terms in this agreement on your own behalf and on behalf of all persons listed on the booking, including any minor under your custody, care or control and direct us and otherwise grant Roam & Gather the authority to perform services for each and every traveler.
Health and Medical. You represent that neither you, nor a traveler in your party, have any condition, physical or mental, that would create a hazard for you or other travelers or affect other people’s enjoyment of the Tour or Service. If you have a physical condition, dietary restrictions, or other conditions (pre-existing medical) that will require special attention during the trip, you must inform us in writing when the booking is made. While Roam & Gather will make reasonable attempts to accommodate said accommodation, Roam & Gather cannot guarantee the fulfillment of said accommodation and will in no way be reasonable for a Third Party Suppliers’ failure to accommodate said accommodation. We may require a medical certificate stating that you are medically cleared for the destination(s) and/or that you are able to participate in all aspects of your trip itinerary. In the event any medical care or health screenings are administered to you during the trip, Roam & Gather assumes no responsibility for any such medical care or health screenings provided to you. You are solely responsible for any and all costs of medical care and related transportation, if any, that are provided to you during the trip.
We require everyone traveling with us to conform to the entry requirements of every location we visit. While it is everyone’s right to decide whether or not they want to receive a vaccination or perform any other required health-related procedure, whether it’s for Covid-19 or any other contagious disease, the failure to or decision not to meet the entry requirements of a location does not qualify as a travel restriction that is the basis for a refund. Roam & Gather strongly recommends that you check with the U.S. Centers for Disease Control and Prevention, or similar entity in your location, for up-to-date, destination-specific information related to food and water safety, infectious diseases, and other concerns.
Roam & Gather does not tolerate drug use of any kind during our trips and strongly encourages responsible alcohol consumption. This policy is in place for your safety and those traveling with you. Roam & Gather reserves the right, at your sole expense, to deny participation in an activity or in the remainder of any trip itinerary if you illegally use drugs, alcohol or other banned substances during a trip.


Payments.
Quotes and Form of Payments. Unless otherwise already quoted on the Site, Roam & Gather may provide an additional quote for the Tour or Service. Quotes provide an estimate only and are not a firm price commitment. Prices are in United States Dollars (USD), and all payments must be made in USD by credit card or other form of payment made available through the Site. We do not store credit card information. Roam & Gather may use third party services to process your payment information for all transactions made through Roam & Gather. You authorize Roam & Gather and its payment service partners to process your payments. These payment processing services are governed by the terms and conditions of those third-party services and will apply to the payments you make through their system.
Incidental Fees. The payments made through Roam & Gather may not include incidental expenses, except as specifically described in your itinerary, and you are liable for all such incidental expenses that you incur during, or in anticipation of, your purchased Tour or Service. These things may include but are not limited to: lunches, alcohol, baggage costs, tips, Covid-related expenses, deviations from any trip itinerary, and any entrance or departure fees into the destination.
Credit Card/ Debit Card Chargeback Policy. We work hard to make our customers happy. If you are not pleased with our Tours or Services for any reason, you agree not to file a chargeback with your credit or debit card company before you have given us an opportunity to address the matter. By agreeing to these Terms, you agree to work with us in good faith to resolve your dispute and acknowledge that chargebacks are not an appropriate way to avoid our cancellation and refund policies


Bookings and Reservations. Reservations Booked More Than 45 Days in Advance of the Tour. To reserve your spot on a Tour or Service, you must initially pay a non-refundable deposit equal to 40% of the overall cost of a Tour or Service. Following this initial deposit, periodic invoices may be required depending on the specific Service or Tour involved. A schedule of said periodic invoice payment and their due dates will be provided to you. The remaining balance for the Tour or Service is due no later than 45 days before the scheduled Tour or Service date. If the remaining balance due for the Tour or Service is not satisfied within 30 days of the Tour or Service or if you fail to timely satisfy the periodic invoice payments, Roam & Gather may cancel your reservation without refund of any monies paid to Roam & Gather.
Reservations Booked Less than 45 Days in Advance of the Tour. To reserve your spot on a Tour, you must pay the entire Tour or Service cost at the time of booking a reservation.
YOU ACKNOWLEDGE AND AGREE THAT CHANGES TO OUR ITINERARIES AND SERVICES CAN BE VERY DISRUPTIVE FOR ROAM & GATHER AS WELL OUR THIRD PARTY SUPPLIERS, AS A RESULT ALL MONIES PAID TO ROAM & GATHER ARE NON-REFUNDABLE UNLESS OTHERWISE STATED HEREIN.
Cancellations by You and Unused Services. No refunds will be provided for any cancellation, unused Services or portions of a Tour, including but not limited to if you leave a Tour or Service for any reason, miss the activity or Tour’s departure time, or have to be removed from a Tour for any reason. There are no exceptions to this cancellation and refund policy, including for reasons related to weather, civil strife, personal, family or medical emergencies or any other circumstances beyond our control. Your decision not to participate in the Tour due to governmental warnings or advisories, fear of travel, or the like, will be deemed a cancellation.
Roam & Gather will not have any liability, owe a refund, or owe any compensation for loss, damage or injury if you, or any other traveler associated with your trip, is infected with an illness, disease or sickness, or if a third party refuses services (e.g., lodging or transport) if you show symptoms of or test positive for an infectious disease. Any loss as a result of the cancelation must be recouped through your traveler insurance
All cancelations made by you must be made in writing. Written cancelations can be emailed to [email protected]. Verbal cancelations will not be accepted. To confirm your cancelation request Roam & Gather will provide you confirmation of the cancellation. We understand that plans may change due to unforeseen circumstances beyond your control. Roam & Gather may allow you to transfer your booking to another traveler. Should Roam & Gather accept the booking transfer, the transferee must accept and comply with the terms stated herein.

Changes by You Prior to Tour Departure. You acknowledge and agree that changes to our itineraries and Tour dates can be very disruptive. If you request to change your Tour or Service dates or alter your itinerary after we confirm your booking but before your trip’s departure date, Roam & Gather will consider your request and whether Roam & Gather can reasonably accommodate your request without any disruption to the Tour or Tour economics. If Roam & Gather is able to make such changes, a “change fee” may be applied. The type and scope of the change dictates the amount of the change fee.
You acknowledge outside supplies, including hotels, often impose additional fees or penalties for changes and cancellations. Substantial change requests by you, such as for example a change of Tour dates, may result in recalculation of your original Tour price. All requests must be made in writing. It is ultimately at Roam & Gather’s sole discretion whether to accept a change request.
Cancellations by Roam & Gather. If a Roam & Gather cancels its Service or Tour before the date of departure for reasons other than Force Majeure and the cancellation is not caused by your fault or negligence, or the fault or negligence of the travelers you booked Services for, your sole remedy will be either one of the following:
1. A substitute Service or Tour of equivalent value; or
2. A substitute Service or Tour of lesser value if no Service or Tour of equivalent value is reasonably availably and to recover from the Roam & Gather the difference in prices between the price of the Service originally purchased and the substitute Service; or
3. A full refund of all monies paid for the cancelled Service.


Roam & Gather is not responsible for any incidental expenses or consequential losses that you incur as a result of the cancelled booking including but not limited to visas, vaccinations, non-refundable flights or rail, non refundable car parking or other fees, loss of earnings, or loss of enjoyment, Roam & Gather reserves the right to issue a full refund in lieu of the choices above, in its sole discretion. Where a significant element of a Service or Tour as described cannot be provided after departure, Roam & Gather will make suitable alternative arrangements where possible. If it is not possible to provide a suitable alternative or if you reasonably reject any suitable alternatives, Roam & Gather may provide you with a refund for the unused Services as determined in its discretion.
Travel Advisories and Warnings. You must conduct your own research and become informed about the destinations in your trip itinerary, including knowledge about any travel advisories and warnings issued by government authorities in your country. In the U.S., you must consult the U.S. State Department’s website at www.travel.state.gov or contact them by phone at the number specified on their website. You are responsible for protecting your own well-being and personal property before, during, and after your Roam & Gather trip. This includes ensuring any and all vaccinations, inoculations, or prescribed medications are taken as directed by your local doctor and/or travel clinic for the areas visited.
Insurance Requirements. You agree and acknowledge that in order to participate in a Tour or Service, sufficient travel insurance is required. It is mandatory that all travelers obtain travel insurance with a minimum coverage of $200,000 USD while traveling with Roam & Gather. The insurance must adequately cover travelers for medical expenses, accidents, property loss, and curtailment or cancellation of your trip. You agree to assume all costs of medical care and transportation that is provided to you, and any minors traveling with you, during the trip.
We recommend the additional protection offered by a comprehensive travel insurance policy that includes trip cancellation/interruption coverage, as this is the only way to protect your financial investment should you unexpectedly be unable to travel. Such insurance is not included with your purchase and Roam & Gather will not provide this to you. Travelers must be able to provide proof of insurance purchase and adequate coverage as per the required amounts above if requested by a Roam & Gather representative.
Documentation.
Pre-Departure Documentation. It is important that you carefully read all documents that you receive from us as soon as you receive them. It is your responsibility to contact us if any information is incorrect. We are not responsible for any errors in documentation if you fail to notify us of any inaccuracies within 30 days of your receipt of those documents. This agreement, our liability waiver, and, if required, a medical statement or certification must be signed and submitted by you in order to travel with us. If we do not receive these signed documents from you prior to departure, we reserve the right to treat your booking as cancelled and impose the cancellation procedures described herein. Any information provided to you is merely provided as a courtesy and it is your sole responsibility to ensure you have met all travel requirements for each destination in your itinerary.
Passports and Visa. You acknowledge and agree that during Roam & Gathers’s Services you may be required to present identifying identification to Third Party Suppliers. You are responsible for ensuring that all necessary travel documents are valid and effective and in your possession for the entire Service or Tour. Valid passports are required for travel to most destinations. Please check with the appropriate consulate or embassy for the latest entry requirements. You assume complete and full responsibility for, and hereby release Roam & Gather from any duty of, checking and verifying any and all passport, visa, vaccination, or other entry requirements of each destination, and all safety or security conditions at such destinations.
Roam and Gather is not responsible for delays, changes, or cancellation costs due to incorrect, incomplete or expired traveler documents. In the event that you must cancel, delay or reschedule your trip due to expired or missing travel documentation, you are responsible for all associated costs to rectify the situation. If you are unable to join your trip, you will not be reimbursed or refunded any amounts as per the Terms herein.


Acceptance of Risk. You acknowledge that travel and Services offered by Roam & Gather may involve a significant amount of risk to your health and safety. By traveling with Roam & Gather you acknowledge that you have considered any potential risks to health and safety. You hereby assume responsibility for all such risks and release Roam & Gather from all claims and causes of action arising from any losses, damages or injuries or death resulting from risks inherent in travel, including adventure travel, visiting foreign destinations, and participating in activities such as those included in our itineraries or otherwise offered by Roam & Gather. Roam & Gather requires that you confirm your assumption of this responsibility by completing the participation waiver (the “Waiver”) prior to departing on your tour.
You acknowledge that the degree and nature of personal risk involved depends on the Services booked and the location(s) in which a Service operates, and that there may be a significant degree of personal risk involved in participating, particularly participating in physical activities, travel to remote locations, carriage by watercraft, participation in “extreme sports” or other high-risk activities, or travel to countries with developing infrastructure.
Standards of hygiene, accommodation and transport in certain countries where Services take place are often lower than the standards you may reasonably expect in your home country or region. You agree that Roam & Gather is not responsible for providing information or guidance with respect to local customs, weather conditions, specific safety concerns, physical challenges or laws in effect in any locations where a Tour or Service is operated. You acknowledge you have considered the potential risks, dangers and challenges and your own personal capabilities and needs, and you expressly assume the risks associated with travel under such conditions.
You must at all times strictly comply with all applicable laws and regulations of all countries and regions. Should you fail to comply with the above or commit any illegal act when on Tour or, if in the reasonable opinion of the Roam & Gather, your behavior is causing or is likely to cause danger, distress or material annoyance to others, Roam & Gather may terminate your travel arrangements on any product or service immediately at your expense and without any liability on Roam & Gather’s part. You will not be entitled to any refund for unused or missed services or costs incurred as a result of termination of your travel arrangements, including, without limitation, return travel, accommodations, meals, and incidentals.
You are responsible for any costs (including repair, replacement and cleaning fees) incurred by the Roam & Gather and Third Party Suppliers who are in connection with the Services or Tours for property damage, destruction or theft caused by you while on Tour or Service. You agree to immediately report any pre-existing damage to a representative of Roam & Gather and Third Party Supplier staff, transportation service, or facility as soon as possible upon discovery
You agree to take all prudent measures in relation to your own safety while on Tour or Service including, but not limited to, the proper use of safety devices (including seatbelts, harnesses, flotation devices and helmets) and obeying all posted signs and oral or written warnings regarding health and safety. Neither the Roam & Gather nor its Third Party Suppliers are liable for loss or damages caused by your failure to comply with safety instructions or warnings.
Indemnification.
You agree to defend, indemnify, and hold harmless Roam & Gather from all liabilities, claims, losses and expenses, including attorney’s fees, that may arise, directly or indirectly from, as a result of or in connection with (i) your use of the website and/or the Services and/or your participation in a Tour, including any damages, whether to persons or property, or death to any person, (ii) your engagement with Third Party Suppliers and (iii) any violation by you of these Terms, including any infringement of any rights of third parties. Roam & Gather reserves the right, at its own expense, to assume the exclusive defense and control of any claim subject to indemnification by you, in which case you agree to cooperate with the Roam & Gather in asserting any available defenses.


Prohibited Activities.
The content and information on the Site (including, but not limited to, price and availability of travel services) as well as the infrastructure used to provide such content and information, is proprietary to us. While you may make limited use of travel itinerary and related documents for travel or service reservations booked through the Site, you agree not to otherwise modify, copy, distribute, transmit, display, perform, reproduce, publish, license, create derivative works from, transfer, or sell or re-sell any information, software, products, or services obtained from or through the Site. You also agree not to (i) use the Site or its contents for any commercial purpose, (ii) make any false or fraudulent reservation; or (iii) access, monitor, or copy any content or information of the Site using any robot, spider, scraper, or other automated means or any manual process for any purpose without our express written permission


This website is protected by copyright, trademark, and/or other laws. All trademarks and logos used on or in connection with the website or services are trademarks owned by Roam & Gather. You acknowledge and agree that the website and all its components, texts, graphics, data, designs, look and feel, photographs, sounds, images, software, videos, and other content, including all associated intellectual property rights are the exclusive property of Roam & Gather and/or its licensors or authorizing third-parties, and is protected in all forms, media and technologies. You may not copy, download, use, edit or retransmit any Proprietary Material, in whole or in part, without the prior written permission of Roam & Gather.


Images and Marketing. You agree that, while participating in any Tour or Service, images, photos or videos may be taken by other participants, Roam & Gather or its representatives that may contain or feature you. You consent to any such pictures being taken and grant a perpetual, royalty-free, worldwide, irrevocable license to Roam & Gather, its contractors, sub-contractors and assigns, to reproduce for any purpose whatsoever (including marketing, promotions and the creation of promotional materials by or with sub-licensees), in any medium whatsoever, whether currently known or hereinafter devised, without any further obligation or compensation payable to you.
Force Majeure. Roam & Gather will not be deemed in breach of this agreement or otherwise liable to you, by reason of delay in performance or non-performance of any of its obligations under this agreement to the extent that any such delay or non-performance is due to any Force Majeure. “Force Majeure” means any circumstances beyond our reasonable control, including without limitation acts of God, terrorist activities, insurrection, explosion, flood, tempest, forceful wind, typhoon, fire or accident, war or threat of war declared or undeclared, sabotage, civil disturbance, labor strikes, requisition, sickness, quarantine, pandemic, epidemic, diseases and viruses that are known, unknown or novel such as coronavirus/Covid-19 (including any spread thereof), foodborne, airborne, and communicable illnesses and disease, government intervention of any kind that affect domestic and/or international travel, government restrictions or warnings, diplomatic or health organization (e.g., World Health Organization) warnings, border closings, weather conditions, and unforeseen circumstances.
In the uncommon situation where Force Majeure prevents, significantly hinders, or makes it impossible for us or our suppliers to provide the services including but not limited to your Tour, we and/or our suppliers shall be entitled to, in our sole and absolute discretion, take one or more of the following steps: cancel, alter, modify, postpone, or reschedule any tour itinerary or arrangement, including Tour dates and the entire Tour itself. You understand and agree that we will not be able to pay you any compensation, costs, or expenses you incur as a result of Force Majeure. We regret that no refunds will be provided if we take any of the preceding actions due to Force Majeure, unless and to the extent we are able to obtain any refunds from our suppliers.
General Provisions.
Waiver. Failure by Roam & Gather to enforce any provision of these Terms shall not be construed as a waiver of any provision or right.
Amendments. Roam & Gather may modify these Terms from time to time in its sole discretion. If we make changes to these Terms, we will post the updated terms on our website. If You continue accessing our website and using our services, then You are deemed to have accepted the amended terms and conditions. If You do not agree to the amended terms and conditions, You will terminate these Terms and Conditions before the date they become effective, and will stop accessing our website and using our Tours and related services.
Governing Law. All services and Tours are provided by Roam & Gather. These Terms, and all other aspects of the use of our website, shall be governed by and construed in accordance with the laws of the state of Illinois.
Entire Agreement. These Terms constitute the entire agreement between the parties with respect to its subject matter, and supersedes all prior agreements, proposals, negotiations, representations or communications relating to the subject matter.
Severability. If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall remain valid and enforceable to the fullest extent possible and shall remain in full force and effect.
Successors. These Terms will inure to the benefit of and be binding upon the parties and their respective heirs, legal and personal representatives, executors, estate trustees, successors and assigns.
