TopCut LLC asks customers to remain inside the house or off the property while work is being performed. TopCut LLC is not responsible for any injuries or damages to persons or property due to the negligence of customers. We ask that the property service area be cleared of all debris including but not limited to pet waste, toys, lawn furniture, rocks newspapers, electrical cords, and etc… Additionally, we request that any protruding objects that can cause damage to machinery such as fence posts, tree stumps, tall sprinkler heads, edging, or large rocks be marked or removed prior to the date of service. Damages to TopCut LLC equipment, machines caused by these factors may result in termination of this agreement and/or additional billing for costly repairs to equipment.

I understand and agree this is a seasonal maintenance account and services are performed through the winter season which is October 15th-April 15th. I fully understand and agree that TopCut will be performing snow removal service in accordance with this agreement and accumulation ranges during these date ranges.

I understand and agree that the price for snow removal for a standard sized residential driveway consists of snow blowing the driveway, sidewalks, shoveling steps or walkways and clearing a path on the front porch up to the door. Any additional areas such as a back patio, walkway on the side of the house, etc... will be an additional cost and need to be specified and agreed to when setting up service.

I understand and agree that snow removal will be performed when accumulation of snow reaches 2" in depth. I understand that accumulation may vary depending on my exact location, which direction my house faces, direction of wind gusts/drifts, etc... I understand and agree this is left to the discretion of Topcut staff.

I understand and agree that snow removal will be performed in accordance with this agreement for EVERY storm above 2" from the time I engage in this agreement to the date specified that this agreement will end.

I understand and agree that in some instances for long lasting storms with continuous snowfall my property may need to be serviced multiple times. I understand and agree that in these scenarios I will be billed when multiple services are performed even for a single storm. I also understand and agree that if a singular service is performed the rate will be applied based on the accumulation and rates provided to me. I understand this is up to the discretion of TopCut LLC staff and service providers.

I understand and agree that in expectation of an upcoming storm I will clear my driveway of any debris, newspapers, electrical cord or anything that could be hazardous to TopCut LLC staff or equipment. I understand that any damage or injury to TopCut LLC staff or equipment may result in severance of this agreement with cancellation fees or fees for damages being applied. TopCut LLC holds no liability for damages resulting from debri or objects hidden under the snow.

I understand and agree that snow blowing and shoveling by its very nature involves pushing a steel blade or a rotating paddle over the surface of the pavement.  If your pavement is defective, deteriorated, weakened, frost heaved or was installed improperly, the results of this previous damage are more likely to appear after snow plowing, blowing or shoveling. TopCut LLC is not responsible for any damages to pavement or curbs unless TopCut LLC has been negligent.

I understand and agree TopCut LLC  operators will service as close to garage doors, side of the driveway and other obstacles as the operator deems safe.  To avoid damage, there will always be a strip of snow in front of garage doors that will not be serviced.  If there is a car or other obstacle blocking part of your driveway or lot, TopCut LLC will service whatever areas the operator deems safe.  You will be charged the regular price for the work.  If the car is moved and the client requests TopCut LLC to re-service the driveway to clear the blocked area, there may be an additional charge.  The price for your service is based on TopCut LLC being able to remove and place the snow into the area of its choice.  If this area is blocked or we are unable to move the snow to that area for any reason, removal may not be completed to the normal sized area and /or there may be additional charges.

I understand and agree that 30 days notice to cancel service is required AND a cancellation fee equal to 1 month of service OR $150 (whichever is greater) will be assessed. I understand that TopCut LLC took me on as a customer and consequently may have turned other season long customers away. I am committed to service for the entirety of the season and agree to the cancellation terms and fees. Requests to cancel service must be in writing and emailed to Info@TopCutLLC.com

I understand and agree that TopCut LLC offers multiple ways to pay my bill electronically using “fee” free electronic forms of payment such as Zelle, Quickpay, Venmo, and PayPal which all are provided on TopCut monthly invoices.

I understand and agree I must keep a valid credit card on file to charge if I am late on a payment. If I elect to pay via credit card or if my credit card is charged due to a delay in payment there will be a convenience fee of up to 4% added to my invoice.

I understand and agree that my invoice is due upon receiving it. If I fail to make payment within 5 days of receiving the invoice I understand there will be a $25  late fee applied to my bill. I will check my spam folder and be prepared to receive my invoice by the end of each month or the 1st of the following month at the latest. Additionally, if my bill continues to go past due there will be a $5 per day late fee applied.

I understand and agree this is a seasonal maintenance account and mowing services are performed weekly through the end of the mowing season which is October 31st. I fully understand that TopCut does not offer bi weekly service.

I agree and understand that TopCut LLC only offers multi year contracts for either two or three years. Please make your selection below.

I understand and agree that here in Colorado weather can change abruptly and without warning I understand that on occasions my service may be rescheduled or moved to another day based on weather conditions and other scheduling factors outside of TopCut LLC’s control. If service is skipped or rescheduled due weather or other factors outside of TopCut LLC control and cannot be rescheduled due to these factors, I understand I may be charged for significant overgrowth the next visit.

I understand and agree that with the fluctuating weather I need to change my watering schedule periodically throughout the summer to ensure a healthy lawn. Or coordinate with TopCut to adjust the sprinkler timer settings to ensure adequate health and growth of my lawn.

I understand and agree that my lawn will be serviced weekly. Even in warm months when the weather gets warm and the growth slows. I understand and agree this is a weekly maintenance service and my lawn will be maintained weekly in accordance with this agreement even if there are areas in my lawn that have not shown significant growth since the last service..

I understand and agree that I am responsible for the TopCut crew to have access and a clear pathway to mow all areas of the property. If access is blocked due to aggressive pets, pet waste, debris, trash cans, furniture, other contractors working in the area or for any other reason then I understand I will still be charged for the visit and additionally charged if a seperate visit is needed to complete the service.

I understand and agree that unless otherwise specified and agreed upon, lawn mowing services are limited to what is inside the perimeter border of my lawn. No additional weed whacking or trimming will be performed on vegetation or weeds outside of my lawn borders or edging. I understand this needs to be requested and scheduled as a separate regular maintenance service and is not included in a standard service unless otherwise specified.

I understand and agree that TopCut LLC crew members will be using in most cases stand on OR ride on lawn mowers made for residential use. In some cases a push mower may be used; this is left to the discretion of TopCut crew members based on their training and professional experience on how to best care for my lawn.

Leaf control offered in the month of October is described as a service to maintain falling leaves throughout the month before the final “fall” of leaves. This service will take approximately as long as a mowing service and is not considered a cleanup. If a cleanup is required I understand and agree that I will be charged the hourly rate for a cleanup service. Additionally, I understand and agree that due to the nature of how leaves fall over a period of time and not always all at once, it may be necessary to have multiple cleanups done during the fall.

Weed Control Spray is a product used and intended to kill weeds and prevent new weeds from sprouting. Once applied for best effect the applied area will need direct sunlight for several hours. I understand and agree that areas that have been sprayed may in some cases take several days to show effects. I understand and agree that it is my responsibility to reschedule my weed control service if I believe the weather may have a negative effect or diminish the effectiveness of my weed spray service. I also understand and agree that weeds are extremely resilient and in addition to spray may need to be pulled. I understand and agree that after weeds are sprayed they will STILL be present in my lawn/yard and unsightly dead weeds will need to be removed. I understand and agree that even with a regular weed control service it is likely that I will still have weeds present. I understand and agree that TopCut LLC does NOT provide weed pulling services.

I understand and agree that 30 days written notice to cancel this contract  is required AND a cancellation fee equal to 1 month of service OR $150 (whichever is greater) will be assessed. I understand that TopCut can only get to so many properties in a given day/week/month/season. By engaging in this contract it is likely that TopCut LLC has turned other potential season-long customers away based on the arrangement to service my property for the entire season. Therefore, I agree to give 30 days notice to cancel as well as pay the cancellation fee as described in this agreement.

I understand and agree that any complaint or dispute about a service must be made within 24 hrs of the service being provided. If I have a complaint or a dispute about the quality of the service or whether or not a service was provided I must notify the TopCut office via phone as well as send an email in order for my complaint to be addressed. We ask that any complaints be addressed within a reasonable time frame of when the service was provided.

I understand and agree that TopCut LLC billing cycles are on the 1st and 15th of every month and that my invoice is due upon receipt.

I understand and agree that my invoice is due upon receipt. If I fail to make payment within 3 days of receiving the invoice I understand there will be a $50 late fee applied to my bill. I will check my spam folder and be prepared to receive my invoice via text or email by the 1st and 15th of each month.. I understand that in most cases TopCut has provided services to me for multiple weeks without pay. Therefore I agree to pay promptly once my invoice is received.
