Permanent Jewelry Waiver & Release of Liability

This Waiver and Release of Liability ("Agreement") is made between the undersigned client ("I") and Linked by Allie Permanent Jewelry ("Linked by Allie") for the application of permanent jewelry services, including but not limited to welding, fitting, and maintenance.

Thank you for choosing Linked by Allie Permanent Jewelry for your permanent jewelry experience. Please read this waiver carefully. By signing, you acknowledge and agree to the following terms and conditions:

Voluntary Participation

I understand that I am choosing to receive a jewelry experience that involves custom-fitting and welding of chain & jump rings directly onto my body (or a minor's body for whom I am responsible) to create a clasp-free, long-term piece of jewelry.

Permanent Jewelry Definition

I understand that while this jewelry experience is widely referred to as "permanent jewelry", it is still my/the wearer's responsibility to treat the jewelry with care and try to mitigate damage or breakage.

I understand that calling it "permanent jewelry" does not guarantee that the jewelry is unbreakable or will remain on the body forever.

I acknowledge that the jewelry is designed to remain on the body for an extended period of time but can be removed at any time with scissors or cutting tools.

I understand that it is my responsibility to assess whether permanent jewelry is appropriate for my/the wearer's lifestyle, profession, or any personal circumstances that may require removal.

Medical Disclosure and MRI/Procedure Removals

I understand that certain procedures, including MRIs, surgeries, and emergency situations, may require the jewelry to be removed.

I understand it is my/the wearer's responsibility to inform medical professionals of the permanent jewelry.

I acknowledge that Linked by Allie and its owners, employees, and affiliates will NOT be held liable for any medical complications, scheduling conflicts, or costs associated with the removal or replacement of jewelry for medical purposes.

I understand that removal is safe and simple and can be done by cutting the jump ring or chain with scissors or cutting tools.

Breakage, Snags, and Lifestyle Risks

I acknowledge that the jewelry may snag or break due to daily activities, especially if I/the wearer participate(s) in contact sports, work in environments with machinery or contact with chemicals, or expose(s) the chain to excessive tension or pulling.

I understand that Linked by Allie is not responsible for damage caused by lifestyle choices, accidents, misuse, or normal wear and tear.

I understand that the only warranty provided is for defects that occur at the weld site - breakage elsewhere on the chain may not be covered.

I understand that swimming in chlorine or other chemicals found in pools/hot tubs/natural bodies of water, using harsh chemicals, or applying perfumes, lotions, hand sanitizer, and other beauty products directly on the chain may cause discoloration on the jewelry or weaken the chain.

Aftercare and Maintenance

I acknowledge that I have received and understand the jewelry care instructions provided by Linked by Allie, which include: gently cleaning the jewelry with mild soap and water, avoiding direct exposure to lotions, perfumes, and chlorine, and monitoring the weld site periodically for any signs of separation or breakage.

I confirm that I am over the age of 18, and/or I am the legal guardian providing consent for a minor to receive permanent jewelry.

I am not under the influence of alcohol or drugs at the time of service.

I am not aware of any allergies to the metals used in the jewelry I have selected to purchase and/or wear, or I have disclosed all known allergies prior to the procedure.

Cybersecurity and Information Security

I acknowledge that while Linked by Allie takes reasonable measures to protect personal information and does not sell or intentionally share personal information, no system is completely secure. I release Linked by Allie from any liability for data breaches, cyber attacks, or unintended disclosure of personal information.

Photography and Social Media

I consent to Linked by Allie taking photographs or videos before, during, and after my permanent jewelry session or event for marketing and promotional purposes.

RELEASE OF LIABILITY & INDEMNIFICATION

I agree to release, indemnify, and hold harmless Linked by Allie, its owners, employees, and affiliates from any and all claims, demands, actions, damages, injuries, allergic reactions, infections, or other health or skin issues that may result from the jewelry materials, jewelry welding & application process, or jewelry removal.

I understand and agree that Linked by Allie, its owners, employees, and affiliates are not liable for loss of jewelry, breakage not related to the weld site, or the need for removal due to lifestyle or medical procedures.

I VOLUNTARILY ASSUME ALL RISKS ASSOCIATED WITH THE APPLICATION, REMOVAL, AND WEARING OF PERMANENT JEWELRY.
