In consideration of being allowed to rent and use a bicycle provided by Ocean Island Inn Backpackers Suites (“Ocean Island”), I agree to the following terms:
1. Assumption of Risk
I acknowledge that cycling involves inherent risks, including but not limited to accidents, falls, equipment failure, road hazards, and collisions. I voluntarily assume full responsibility for any injuries or damages that may occur while using the bicycle.
2. Release of Liability
I hereby release and discharge Ocean Island, its owners, employees, and affiliates from any and all claims, demands, or causes of action resulting from any loss, injury, damage, or death arising out of or in connection with the use of the rental bicycle, including claims caused by Company negligence.
3. Responsibility for Equipment
I agree to return the bicycle and all provided accessories (helmet, lock, lights, etc.) in the same condition as received, except for normal wear and tear. I accept full financial responsibility for any loss, theft, or damage to the bike or accessories during the rental period.
4. Credit Card Pre-Authorization
I authorize Ocean Island to
pre-authorize my credit card for $200 to ensure it’s validity as a security deposit. This hold is not a charge and will be released when the bicycle and all accessories are returned in acceptable condition. If the bicycle is lost, stolen, or damaged beyond repair, I authorize the Company to charge up to $1,200 CAD to cover replacement or damage costs.
If I do not have a credit card, I have agreed to pay a $200 cash deposit in lieu of a pre-authorization. I agree to pay up to $1,200 CAD if damages or replacement costs exceed $200.
5. Late Returns
I understand that bicycles must be returned by the agreed return time. If the bicycle is returned late, I agree to pay a late fee of $10 per hour (or any portion of an hour). For example, returning the bike 10 minutes late will result in a $10 charge; returning it 1 hour and 10 minutes late will result in a $20 charge.
6. Prevention of Theft
I agree to take all reasonable precautions to prevent theft of the rental bicycle. This includes:
• Locking the bike through the frame and front wheel to a fixed, immovable object when not in use.
• Using the lock provided by the Company.
• Not leaving the bike unattended in unsecured or high-risk areas.
Failure to properly secure the bike may result in being held financially liable for its loss or theft, up to the full replacement cost of
$1,200 CAD.
7. Intended Use – Road/City Only
I understand and agree that the bicycles provided are intended for city and paved road use only. They are not designed for mountain biking, off-road trails, rough terrain, or stunt riding. I agree not to use the bicycle in any manner inconsistent with its intended use, and I accept full responsibility for any resulting damage or injury caused by misuse.
8. Helmet Use
I acknowledge that a helmet has been offered to me and understand that wearing one while cycling is required in the province of BC. If I decline to wear a helmet, I do so at my own risk.
9. Compliance with Laws
I agree to operate the bicycle in accordance with all applicable traffic laws and safety guidelines. I will not ride under the influence of alcohol, drugs, or other impairing substances.
In Victoria, British Columbia, cyclists have the same rights and duties as drivers of vehicles, with specific regulations in place to ensure safety. Key laws include mandatory helmet use for all cyclists, obeying traffic signals and signs, using lights and reflectors at night, and maintaining a safe distance from parked vehicles to avoid "doorings".

10. Physical Fitness
I certify that I am physically fit to operate a bicycle and do not have any medical conditions that would impair my ability to ride safely.
11. Minimum Age
I confirm that I am 18 years of age or older.
12. Cancellation
I acknowledge and accept that this agreement is non-cancellable and non-refundable. By signing/booking, I waive any rights to claim a refund or initiate a chargeback for any reason.
