PedalRebelVR End User License Agreement

PEDALREBELVR END USER LICENSE AGREEMENT & LIABILITY WAIVER IMPORTANT: READ CAREFULLY BEFORE INSTALLING OR USING PEDALREBELVR This End User License Agreement ("Agreement") is a legal contract between you ("User") and Kovarch Pty Ltd (ABN: 77 672 298 583) ("Company") regarding your use of PedalRebelVR software and services. 1. END USER LICENSE AGREEMENT 1.1 ACCEPTANCE OF TERMS By downloading, installing, using PedalRebelVR, or checking the acceptance box during registration, you acknowledge that you have read, understood, and agree to be bound by this Agreement. If you do not agree, do not use the software. Digital Consent: Your electronic acceptance (checkbox, click-through, or continued use) constitutes a legally binding agreement equivalent to a written signature under the Electronic Transactions Act 1999 (Cth) and applicable state electronic signature laws. 1.15 PHOTOSENSITIVE EPILEPSY AND SEIZURE WARNING
CRITICAL WARNING: SEIZURE RISK
READ THIS WARNING BEFORE USING PEDALREBELVR. SOME PEOPLE ARE SUSCEPTIBLE TO EPILEPTIC SEIZURES OR LOSS OF CONSCIOUSNESS WHEN EXPOSED TO CERTAIN FLASHING LIGHTS OR LIGHT PATTERNS. SUCH SEIZURES OR LOSS OF CONSCIOUSNESS CAN OCCUR EVEN IF A PERSON HAS NEVER EXPERIENCED A PREVIOUS SEIZURE OR LOSS OF CONSCIOUSNESS.
Photosensitive Epilepsy Risk:

▪ Approximately 3% of people with epilepsy are affected by photosensitive epilepsy ▪ Most people who develop photosensitive epilepsy are between 7 and 19 years old ▪ Flashing lights between 5 to 30 flashes per second (Hertz) are most likely to trigger seizures ▪ Some people may experience their first seizure while using VR, even with no previous history of epilepsy ▪ Children and young people under age 20 are at higher risk for visually-induced seizures

Potential Triggers in VR Exercise:

▪ Rapid flashing or flickering lights in game environments ▪ High contrast patterns or geometric designs ▪ Sudden bright light changes during virtual environments ▪ Fast-moving visual patterns during cycling gameplay ▪ Camera flash effects or strobing visual elements ▪ Red flashing lights (particularly high risk) ▪ Transition effects between game scenes

Warning Signs - STOP IMMEDIATELY if you experience:

▪ Seizures, convulsions, or loss of consciousness ▪ Eye or muscle twitching ▪ Involuntary movements ▪ Altered vision, blurred vision, or double vision ▪ Dizziness, disorientation, or confusion ▪ Nausea or light-headedness ▪ Loss of awareness of surroundings

IMMEDIATE ACTION REQUIRED:

DISCONTINUE USE IMMEDIATELY if you or anyone observing you experiences any symptoms ▪ REMOVE VR HEADSET and stop pedalling immediately ▪ SEEK MEDICAL ATTENTION if symptoms persist or seizure occurs ▪ DO NOT RESUME USE until cleared by a medical professional

Prevention Measures:

▪ Ensure you are well-rested before playing (fatigue increases seizure risk) ▪ Avoid playing if you are stressed, ill, or under the influence of any substances ▪ Take frequent breaks (minimum 15 minutes every hour) ▪ Play in a well-lit room to reduce contrast between screen and surroundings ▪ Sit or stand as far back from the VR display as possible ▪ Cover one eye if sudden flashing occurs ▪ If you feel any discomfort, immediately stop and remove headset

HIGH-Risk Situations - Extra Caution Required:

First-time VR users - increased risk during initial exposure ▪ Family history of epilepsy - genetic predisposition increases risk ▪ Previous head injury - may increase susceptibility ▪ Sleep deprivation or illness - significantly increases seizure risk ▪ Alcohol or drug use - dramatically increases risk

Medical Consultation Required: You MUST consult with a physician before using PedalRebelVR if you or anyone in your family has:

▪ A history of epilepsy or seizures of any kind ▪ Ever experienced seizures, blackouts, or loss of consciousness ▪ Ever experienced symptoms when exposed to flashing lights ▪ Been diagnosed with photosensitive epilepsy or any seizure disorder ▪ A family history of epilepsy or photosensitive epilepsy ▪ Any neurological condition that may be affected by flashing lights

Parental Responsibility for Minors:

▪ Parents must inform children about seizure risks before first use ▪ Close supervision required for all users under age 20 ▪ Children may not recognize early warning signs of seizures ▪ Parents must be present and watching for seizure symptoms during play ▪ Any family history of epilepsy must be disclosed to children before use

1.2 PHYSICAL ACTIVITY AND HEALTH WARNINGS CRITICAL SAFETY NOTICE: PedalRebelVR involves physical exercise combined with virtual reality technology, which creates inherent risks. Before using PedalRebelVR, you acknowledge: ▪ You are physically capable of exercising on an exercise bike ▪ You have consulted with a healthcare provider regarding your ability to engage in physical exercise ▪ You understand that VR exercise can be strenuous and may cause injury ▪ You are not pregnant, have no heart conditions, balance disorders, or other health conditions that could be aggravated by physical exercise or VR use ▪ You will stop immediately if you feel dizzy, nauseous, or experience any discomfort SPECIAL CONSIDERATIONS FOR YOUNG USERS: VR and Physical Development: ▪ Children and teens have developing visual systems that may be more susceptible to VR-related discomfort ▪ Extended VR use may affect developing balance and spatial awareness systems ▪ Young users are at higher risk of motion sickness and disorientation ▪ Physical exercise capacity varies significantly during developmental years Mandatory Supervision for Minors: ▪ Users under 16 MUST have adult supervision throughout entire session ▪ Adult supervisor must remain physically present and able to intervene immediately ▪ Supervisor must monitor for signs of fatigue, discomfort, or disorientation ▪ Supervisor must enforce mandatory breaks every 15-30 minutes for users under 18 Age-Specific Usage Limits: ▪ Ages 10-12: Maximum 30 minutes per day, 15-minute sessions with breaks ▪ Ages 13-15: Maximum 60 minutes per day, 30-minute sessions with breaks ▪ Ages 16-17: Maximum 90 minutes per day, 45-minute sessions with breaks ▪ Ages 18+: Use judgment, but breaks every hour recommended 1.3 EQUIPMENT SAFETY REQUIREMENTS You agree to: ▪ Use only properly maintained exercise equipment suitable for your weight and fitness level ▪ Ensure adequate clear space around your exercise area (minimum 2m x 2m) ▪ Secure loose clothing, jewellery, and shoelaces before use ▪ Use appropriate athletic footwear with secure lacing ▪ Have another person present during initial uses ▪ Immediately stop if you experience equipment malfunction ▪ Never use the software if equipment shows signs of wear or damage 1.4 VR-SPECIFIC SAFETY REQUIREMENTS VR Safety Obligations: ▪ Ensure VR headset is properly fitted and calibrated ▪ Take regular breaks (minimum 15 minutes every hour) ▪ Stop immediately if you experience motion sickness, eye strain, or disorientation ▪ Maintain awareness of your physical surroundings despite VR immersion ▪ Never use while under the influence of alcohol, drugs, or medication that affects balance or coordination 1.5 LICENSE GRANT Company grants you a limited, non-exclusive, revocable license to use PedalRebelVR for personal, non-commercial purposes only. 1.6 PROHIBITED USES You may not: ▪ Use the software commercially without written permission ▪ Reverse engineer, modify, or create derivative works ▪ Share account credentials or circumvent security measures ▪ Use the software in any way that violates applicable laws 1.7 INTELLECTUAL PROPERTY All rights, title, and interest in PedalRebelVR remain with Kovarch Pty Ltd. This Agreement does not transfer any ownership rights. 1.8 UPDATES AND MODIFICATIONS Company may update the software and this Agreement at any time. Continued use constitutes acceptance of modifications. 1.9 TERMINATION This Agreement terminates if you breach any terms. Upon termination, you must cease all use and delete all copies of the software. 1.10 GOVERNING LAW This Agreement is governed by the laws of South Australia, Australia. 2. COMPREHENSIVE LIABILITY WAIVER AND RELEASE PLEASE READ THIS DOCUMENT CAREFULLY. IT AFFECTS YOUR LEGAL RIGHTS. 2.1 ASSUMPTION OF RISK I understand and acknowledge that participating in VR exercise activities using PedalRebelVR involves inherent and significant risks of personal injury, including but not limited to: Physical Exercise Risks: ▪ Cardiovascular stress, heart attack, stroke ▪ Muscle strains, sprains, and tears ▪ Joint injuries including knees, hips, ankles ▪ Falls from exercise equipment ▪ Dehydration and heat exhaustion ▪ Aggravation of pre-existing medical conditions VR-Specific Risks: ▪ Motion sickness and disorientation ▪ Loss of spatial awareness while exercising ▪ Collision with objects or people due to VR immersion ▪ Eye strain and visual disturbances ▪ Balance loss due to visual-vestibular conflict ▪ Seizures (particularly for individuals with photosensitive epilepsy) Equipment-Related Risks: ▪ Mechanical failure of exercise bike ▪ Entanglement of clothing or shoelaces in moving parts ▪ Sharp edges or protruding components ▪ Improper equipment setup or calibration ▪ Electrical hazards from VR and exercise equipment 2.2 VOLUNTARY PARTICIPATION I voluntarily choose to participate in VR exercise activities with full knowledge of the risks involved. I understand that no activity is completely safe. 2.3 RELEASE AND WAIVER To the fullest extent permitted by law, I hereby release, waive, and discharge Kovarch Pty Ltd, its directors, officers, employees, agents, and affiliates from any and all claims, demands, actions, or causes of action arising from: ▪ Personal injury, death, or property damage ▪ Any use of PedalRebelVR software ▪ Any malfunction or failure of recommended equipment ▪ Any advice, instruction, or guidance provided ▪ Any negligence by the Company (except gross negligence or willful misconduct) 2.4 INDEMNIFICATION I agree to indemnify and hold harmless Kovarch Pty Ltd from any claims by third parties arising from my use of PedalRebelVR. 2.5 MEDICAL FITNESS AND AGE REPRESENTATION I represent that: ▪ I am at least 10 years old (or my parent/guardian represents this on my behalf) ▪ If under 18, my parent/guardian has reviewed all safety requirements and given informed consent ▪ I am in appropriate physical condition for my age and development level ▪ I have no medical conditions that would prevent safe participation ▪ If under 18, my parent/guardian has consulted with a healthcare provider if there are any concerns ▪ I will immediately cease activity if I experience any adverse symptoms ▪ If under 16, I understand that adult supervision is mandatory throughout all usage For Parent/Guardian (if user is under 18): ▪ I have read and understand all safety warnings and age-specific requirements ▪ I take full responsibility for supervising my child's use of PedalRebelVR ▪ I will enforce all age-appropriate usage limits and safety measures ▪ I understand the unique risks VR exercise poses to developing children ▪ I will monitor my child for any signs of discomfort or adverse effects ▪ I consent to my child's participation with full knowledge of the risks involved 2.6 ACKNOWLEDGMENT OF UNDERSTANDING I have read this waiver and understand its legal significance. I agree voluntarily with full knowledge of its contents. Digital Consent: By checking the acceptance box during registration or first use, you provide legally binding consent equivalent to a written signature under applicable electronic signature laws. 3. TERMS OF SERVICE 3.1 SERVICE DESCRIPTION PedalRebelVR provides VR-enhanced exercise experiences through software that integrates with exercise equipment and VR hardware. 3.2 AGE REQUIREMENTS AND PARENTAL SUPERVISION Minimum Age Requirements: Ages 10-12: May use PedalRebelVR ONLY with direct parental supervision. Parent must be present during ALL usage. ▪ Ages 13-15: Requires parental consent and ongoing supervision. Parent must approve installation and monitor usage. ▪ Ages 16-17: Requires parental consent. Parental supervision strongly recommended. ▪ Ages 18+: No Required supervision. Parental Supervision Requirements: ▪ Parent/guardian must read and acknowledge all safety warnings before minor's first use ▪ Parent/guardian must ensure proper equipment setup and safety measures ▪ Parent/guardian must monitor usage time and take mandatory breaks (maximum 30 minutes continuous use for under-16s) ▪ Parent/guardian assumes full responsibility for minor's use of PedalRebelVR Parental Consent: ▪ Users under 18 require explicit parental consent before account creation ▪ Parents must provide valid contact information for safety communications ▪ Parents may revoke consent and request account deletion at any time ▪ Kovarch Pty Ltd reserves the right to verify parental consent Additional Protections for Minors: ▪ No collection of personal data from users under 13 without verifiable parental consent ▪ Enhanced safety notifications during gameplay for users under 18 ▪ Automatic usage time limits for users under 16 ▪ Priority customer support for safety-related issues involving minors 3.3 ACCEPTABLE USE POLICY Users agree not to: ▪ Violate any laws or regulations ▪ Share inappropriate content ▪ Harass or harm other users ▪ Attempt to gain unauthorized access to systems ▪ Use the service while impaired or medically unfit 3.4 PRIVACY AND DATA COLLECTION ▪ We collect exercise performance data, usage statistics, and technical information ▪ Data is used to improve services and provide personalized experiences ▪ We do not sell personal data to third parties ▪ Users may request data deletion at any time 3.5 SERVICE AVAILABILITY ▪ Services provided "as is" without uptime guarantees ▪ Company reserves the right to modify or discontinue services ▪ Planned maintenance will be communicated when possible 3.6 CONTENT AND USER GENERATED CONTENT ▪ Users retain rights to content they create ▪ Users grant Company license to use content for service operation ▪ Company may remove content that violates terms 3.7 FEES AND PAYMENTS ▪ Current pricing available on website ▪ Fees are non-refundable except as required by law ▪ Automatic renewal may apply to subscriptions 3.8 LIMITATION OF LIABILITY To the maximum extent permitted by law: ▪ Total liability limited to amount paid in past 12 months ▪ No liability for indirect, consequential, or punitive damages ▪ No liability for third-party equipment or services 3.9 SPECIAL PROTECTIONS FOR MINORS Data Protection for Minors: ▪ Users under 13: No personal data collection without verifiable parental consent ▪ Users 13-17: Limited data collection with enhanced privacy protections ▪ Parents may request deletion of all minor's data at any time ▪ No advertising or marketing communications to users under 18 Safety Monitoring: ▪ Enhanced safety alerts for users under 18 ▪ Automatic session termination if safety limits exceeded ▪ Priority response for safety incidents involving minors ▪ Regular check-ins with parents/guardians regarding safety Content Restrictions: ▪ Age-appropriate content filtering for users under 18 ▪ No social features or communication with strangers for users under 16 ▪ Parental controls for content access and features Emergency Procedures: ▪ Clear emergency contact procedures for incidents involving minors ▪ Immediate parent/guardian notification for any safety incidents ▪ Coordination with medical professionals when necessary 4.
