Terms and Conditions

These terms and conditions apply to the mobile applications (hereby referred to as "Applications") created by Milowda (hereby referred to as "Service Provider") as a commercial service.

Upon downloading or utilizing any of the Applications, you are automatically agreeing to the following terms. It is strongly advised that you thoroughly read and understand these terms prior to using any of the Applications. Unauthorized copying, modification of the Applications, any part of the Applications, or our trademarks is strictly prohibited. Any attempts to extract the source code of the Applications, translate the Applications into other languages, or create derivative versions are not permitted. All trademarks, copyrights, database rights, and other intellectual property rights related to the Applications remain the property of the Service Provider.

The Service Provider is dedicated to ensuring that the Applications are as beneficial and efficient as possible. As such, they reserve the right to modify the Applications or charge for their services at any time and for any reason. The Service Provider assures you that any charges for the Applications or their services will be clearly communicated to you.

The Applications store and process personal data that you have provided to the Service Provider in order to provide the Service. It is your responsibility to maintain the security of your phone and access to the Applications. The Service Provider strongly advises against jailbreaking or rooting your phone, which involves removing software restrictions and limitations imposed by the official operating system of your device. Such actions could expose your phone to malware, viruses, malicious programs, compromise your phone's security features, and may result in the Applications not functioning correctly or at all.

Please note that the Applications utilize third-party services that have their own Terms and Conditions. Below are the links to the Terms and Conditions of the third-party service providers used by the Applications:

The Applications may request access to various types of user data, including but not limited to personal information (such as name, email address, phone number), location data, device information (such as model, OS version, IP address), usage data, media and files (such as photos, videos, audio recordings), health and fitness data, contacts, calendar events, reminders, microphone and camera access, notifications, and payment information. These data may be collected, processed, and stored temporarily or permanently to provide and enhance the services offered by the Applications. In some cases, the Service Provider may use and share these data with third-party service providers for various purposes. The Service Provider ensures that any data shared with third-party services is used solely for the intended purpose and is handled in accordance with applicable privacy policies. Users are advised to review the privacy policies of these third-party services for further information on how their data is managed.

Please be aware that the Service Provider does not assume responsibility for certain aspects. Some functions of the Applications require an active internet connection, which can be Wi-Fi or provided by your mobile network provider. The Service Provider cannot be held responsible if the Applications do not function at full capacity due to lack of access to Wi-Fi or if you have exhausted your data allowance.

If you are using the Applications outside of a Wi-Fi area, please be aware that your mobile network provider's agreement terms still apply. Consequently, you may incur charges from your mobile provider for data usage during the connection to the Applications, or other third-party charges. By using the Applications, you accept responsibility for any such charges, including roaming data charges if you use the Applications outside of your home territory (i.e., region or country) without disabling data roaming. If you are not the bill payer for the device on which you are using the Applications, they assume that you have obtained permission from the bill payer.

Similarly, the Service Provider cannot always assume responsibility for your usage of the Applications. For instance, it is your responsibility to ensure that your device remains charged. If your device runs out of battery and you are unable to access the Service, the Service Provider cannot be held responsible.

In terms of the Service Provider's responsibility for your use of the Applications, it is important to note that while they strive to ensure that they are updated and accurate at all times, they do rely on third parties to provide information to them so that they can make it available to you. The Service Provider accepts no liability for any loss, direct or indirect, that you experience as a result of relying entirely on this functionality of the Applications.

The Service Provider may wish to update the Applications at some point. The Applications are currently available as per the requirements for the operating system (and for any additional systems they decide to extend the availability of the Applications to) may change, and you will need to download the updates if you want to continue using the Applications. The Service Provider does not guarantee that they will always update the Applications so that they are relevant to you and/or compatible with the particular operating system version installed on your device. However, you agree to always accept updates to the Applications when offered to you. The Service Provider may also wish to cease providing the Applications and may terminate their use at any time without providing termination notice to you. Unless they inform you otherwise, upon any termination, (a) the rights and licenses granted to you in these terms will end; (b) you must cease using the Applications, and (if necessary) delete them from your device.

Subscription Terms

Subscription Plans: The Applications offer various subscription plans with different access levels and benefits. Detailed information about each subscription plan, including pricing and features, is available within the Applications.
Billing and Payment: Subscriptions are billed on a recurring basis with various durations, such as weekly, monthly, quarterly, bi-monthly, semi-annually, or annually, depending on the plan you select. Payment will be charged to your iTunes Account at confirmation of purchase. Your subscription will automatically renew unless auto-renew is turned off at least 24 hours before the end of the current period. The cost of renewal will be identified, and your account will be charged within 24 hours prior to the end of the current period.
Free Trials: Some subscription plans may include a free trial period. If you do not cancel during the free trial period, you will be automatically charged for the subscription at the end of the trial period.
Cancellation and Refunds: You can manage and cancel your subscription by going to your Account Settings on the App Store. Once you cancel your subscription, you will still have access to the subscription services until the end of the current billing period. Refunds will not be provided for any unused portion of the term.
Termination of Subscription: The Service Provider may terminate your subscription at any time without notice if you breach these terms and conditions. Upon termination, your rights to use the subscription services will cease immediately.

Privacy and Data Usage

Data Collection and Usage: The Applications collect and use personal data as described in the Privacy Policy. By using the Applications, you agree to the collection and use of information in accordance with this policy.
Third-Party Services: The Applications use third-party services to enhance your experience. These services have their own privacy policies and terms of use, which you are advised to review.

Dispute Resolution

Governing Law: These terms and conditions are governed by and construed in accordance with the laws of the country in which the Service Provider is based.
Arbitration: Any disputes arising out of or in connection with these terms shall be resolved through binding arbitration in accordance with the rules of the relevant arbitration institution. The decision of the arbitrator will be final and binding on both parties.

Miscellaneous

Severability: If any provision of these terms and conditions is found to be invalid or unenforceable, the remaining provisions will remain in full force and effect.
Entire Agreement: These terms and conditions constitute the entire agreement between you and the Service Provider regarding your use of the Applications and supersede any prior agreements or understandings.

Changes to These Terms and Conditions

The Service Provider may periodically update their Terms and Conditions. Therefore, you are advised to review this page regularly for any changes. The Service Provider will notify you of any changes by posting the new Terms and Conditions on this page.

These terms and conditions are effective as of 2024-05-20.
