I acknowledge that participation in competitive track and field involves inherent and extraordinary risks—physical injury, illness (including communicable diseases), property damage, or death—even when reasonably supervised. I voluntarily assume all risks, known and unknown, foreseeable and unforeseeable, including risks arising from negligence of Released Parties.
In consideration of being permitted to participate, I, on behalf of myself (and on behalf of my child, if a minor), my heirs, representatives, and assigns, hereby irrevocably RELEASE, WAIVE, DISCHARGE, AND COVENANT NOT TO SUE the Released Parties from any and all liability, claims, demands, causes of action, damages, costs, or expenses (including attorneys’ fees) arising out of or related to any loss, damage, injury, or death that may occur during participation, travel to/from the event, or presence on premises—whether caused by the negligence of Released Parties or otherwise.
I agree to DEFEND, INDEMNIFY, AND HOLD HARMLESS the Released Parties against any claim, suit, loss, expense, or damage (including attorney’s fees and costs) arising from my (or my child’s) acts or omissions, breach of this Agreement, or participation in the event—regardless of fault.
I certify that I (or my child) am physically fit, have no medical condition contraindicating participation, and will comply with all rules and instructions. I authorize emergency medical treatment and agree to be solely responsible for all related costs. I RELEASE the Released Parties from any liability for first aid, treatment, or emergency response.
I acknowledge that the Released Parties carry no insurance covering participants. I am responsible for personal health, accident, or liability insurance. NO EXPRESS OR IMPLIED WARRANTIES—of merchantability, fitness for a particular purpose, or otherwise—are made by Released Parties.
I acknowledge that Vandergrift High School premises are used “as‑is.” I hereby RELEASE Leander ISD and Vandergrift High School from liability for any injury or damage arising from defective or dangerous conditions of the premises.
I grant the Released Parties permission to photograph, videotape, or record my participation (or that of my child) and to use such media for promotional, educational, or commercial purposes without compensation.
I agree that any dispute arising under this Agreement shall be resolved by confidential, binding arbitration in Travis County, Texas under the rules of the American Arbitration Association, and I WAIVE any right to a jury trial or to participate in a class, collective, or representative action.
This Agreement is governed by the laws of the State of Texas. Venue for all disputes shall lie exclusively in the state or federal courts in Travis County, Texas, subject to Section 10 above.
If any provision is held unenforceable, the remainder remains in full force. Sections 3 – 12 survive the termination of this Agreement.
I HAVE CAREFULLY READ, FULLY UNDERSTAND, AND VOLUNTARILY AGREE TO ALL TERMS AND CONDITIONS OF THIS AGREEMENT, WAIVING ALL RIGHTS TO SUE FOR ANY CLAIM I MAY HAVE, INCLUDING THOSE ARISING FROM THE NEGLIGENCE OF RELEASED PARTIES.
