Snarky Elephant Productions (SEP Pitch Portal)

Snarky Elephant is accepting projects looking for a production partner in film or theater.
At Snarky Elephant, we believe that organizations should serve as supports for the continued growth and success of creatives, not to create further barriers. As such, we are have a pitch portal for creators to send us projects. Our mandate is broad: we accept narrative films, documentary films, tv series, musicals, and other plays presented in whatever way you imagine them! We accept any length or genre as long as your pitch shows how your project delves into issues and ideas that are often left unexamined and captures underrepresented perspectives.

In order to be considered, you MUST submit the following:

• Summary
• Professional Bio
• Agreement to the SEP Release Form
The following are not required to submit, but are appreciated:
• Pitch deck
• Script
• If applicable, TV Bible
• If applicable, a documentary outline
• Examples of prior film or theater work presented in video form
• Other materials you feel best represent your project

Submission Release Form
Snarky Elephant Productions, LLC (Snarky Elephant Productions LLC hereafter referred to as ‘Snarky Elephant’) thanks you for your interest in submitting to our Pitch Portal. Snarky Elephant will only consider Projects and connected Materials if their Owner(s) agree to the following release form.
I assert the Project and its Materials (screenplay, script, treatment, outline, pitch deck, and all other documentation/information I submit to the Pitch Portal) is submitted by me for review and consideration by Snarky Elephant. I understand that the execution of this release is necessary before Snarky Elephant will review the Project, and I represent and agree to the following terms and conditions:
1. I own or control the Project and its Materials. I have the full and exclusive right to submit all Materials under my Project to Snarky Elephant and no other person or entity has any right, title or interest in the work inconsistent with my rights to develop and license the Project.
2. The Project is not defamatory and does not infringe upon or violate the privacy rights, copyrights, trademarks, publicity or other intellectual or proprietary rights of any third party.
3. The Project is an original work that does not contain plagiarized Materials or Materials licensed by another entity that I am not authorized to use.
4. I knowingly acknowledge that I have no prior agreement with Snarky Elephant for my Project and its Materials. I knowingly acknowledge that submitting my Project and Materials to Snarky Elephant does not create a binding agreement with me about the Project, and Snarky Elephant does not have an obligation to use the Project or review the Project in any way. There is no agreement, written or oral, express or implied, between Snarky Elephant and I concerning the Project, other than this release.
5. I understand and agree that submission and/or review of my Project and Materials by Snarky Elephant does not imply compensation in any way.
6. Snarky Elephant will give the Project only the consideration that Snarky Elephant in its sole and absolute discretion determines is appropriate.
7. Snarky Elephant does not waive its right to research, confirm/contest my copyrights, trademarks, or intellectual property rights.
8. Snarky Elephant does not accept any obligation regarding confidentiality with respect to the Project and its Materials. Snarky Elephant has the right to copy, use, distribute, and discuss the Project and its Materials with its employees, collaborators, volunteers, officers, directors, and associates for the sole purpose of its evaluation and review.
9. Snarky Elephant has no obligation to return the Project Materials to you and is not responsible for any loss or damage to the Project Materials.
10. Snarky Elephant may have already and may in the future receive or independently develop Materials containing elements identical to or similar to the Project and its Materials. I agree to renounce any claim that Snarky Elephant misappropriated any ideas or portions of my Project, its Materials, or my submission. I indemnify Snarky Elephant and hold Snarky Elephant harmless from any claim, loss, obligation, or liability, or expense including attorneys fees that may be asserted against Snarky Elephant or incurred by Snarky Elephant in connection with my Project, its Materials, and my submission. This release extends to Snarky Elephant, its agents, associates, employees, officers, directors and volunteers.
11. I understand and agree that I will not be entitled to any compensation because of the use by Snarky Elephant of any such similar or identical material.
12. In the event of any dispute concerning said Project and any of its Materials or concerning any claim of any kind or nature arising in connection with said Materials or arising in connection with this agreement, such dispute will be submitted to binding arbitration. Each party hereby waives any and all rights and benefits in which either party may otherwise have or be entitled to under the laws of the State of New York to litigate any such dispute in court, it being the intention of the parties to arbitrate all such disputes. Either party may commence arbitration proceedings by giving the other party written notice thereof by registered mail and proceeding thereafter in accordance with the rules and procedures of the American Arbitration Association. The arbitration shall be conducted in Kings County, State of New York, and shall be governed by and subject to the laws of the State of New York and the then prevailing rules of the American Arbitration Association. The arbitrators’ award shall be final and binding and a judgment upon the award may be enforced by any court of competent jurisdiction.
13. Should any provision or part of any provision be void or unenforceable, such provision or part thereof shall be deemed omitted, and this agreement with such provision or part thereof shall remain in full force and effect.
