Jogging Paws Participation Waiver and Release of Liability

IMPORTANT – PLEASE READ CAREFULLY BEFORE PARTICIPATING

By signing and submitting this form, you (the "Participant") acknowledge and agree to the terms and conditions outlined below. This waiver and release of liability is a legally binding agreement and will remain in effect for all future events hosted by Jogging Paws (the “Organizer”), including any affiliated brands, umbrella companies, or entities created in the future. This waiver also applies to the Organizer personally, whether or not any formal legal entity exists now or in the future.


1. Voluntary Participation

I, the undersigned, acknowledge that my participation in any Jogging Paws event — including but not limited to walking, jogging, running, gathering, socializing, and activities involving dogs — is entirely voluntary and undertaken at my own risk. These events take place in public parks and spaces and are not organized in affiliation with or sanctioned by any local, state, or federal entity.


2. Assumption of Risk

I fully understand that participating in physical activity and being in environments where dogs are present involves inherent risks, including but not limited to: falls, dog bites, allergic reactions, personal injury, animal aggression, weather conditions, terrain risks, and other potential hazards, including the behavior of other participants and animals.

I willingly assume all such risks, including those that may arise from the negligence (including gross negligence), recklessness, omissions, or misconduct of the Organizer or any third party, including other participants or venue partners.


3. No Liability

I hereby fully and forever release, waive, discharge, and hold harmless the Organizer (as an individual), any of their future business entities, affiliated brands, volunteers, contractors, event hosts, property owners, sponsors, or associated partners from any and all claims, liabilities, demands, damages, actions, or causes of action whatsoever, in law or equity, arising out of or related to any injury, death, loss, or damage sustained by me, my property, my pet(s), my children, or my unborn child(ren) as a result of my participation in Jogging Paws events.

This includes, but is not limited to:

Physical injury or death
Property damage
Emotional distress
Dog behavior or altercations
Allergies or illnesses
Misinterpretations of services
ADA disputes or misunderstandings
Jogging Paws meets in public spaces and is not responsible for accessibility issues. Any ADA-related grievances must be directed toward the governing city or venue, not the Organizer.
4. Parental Responsibility

If I bring a child or minor to an event, I certify that I am their legal guardian and take full and complete responsibility for their safety, behavior, well-being, and any potential injuries or damages they may cause or incur. This waiver includes all claims on behalf of minors and unborn children.


5. Responsibility for Dogs

I accept full responsibility for my dog(s) at all Jogging Paws events. I confirm that my dog(s) are properly licensed, vaccinated, leashed, and under my control at all times. I will immediately remove my dog(s) from the event if they exhibit aggression or dangerous behavior. I understand I am legally and financially responsible for any injury or damage caused by my dog(s).


6. No Guarantees or Promises

I acknowledge that Jogging Paws does not make any guarantees, warranties, or representations regarding health benefits, social outcomes, partnerships, exposure, services rendered, or any form of benefit — explicit or implied — related to participating in events or collaborating as a sponsor, vendor, or volunteer.


7. Medical Treatment & Insurance

I certify that I am in good health and physically capable of participating. I understand that the Organizer does not carry or provide medical, liability, pet, or personal insurance. I am responsible for securing my own insurance coverage if desired.


8. Photo/Video Release

I grant Jogging Paws permission to capture and use photos, videos, and user-generated content from events that may include my image, likeness, pet(s), or voice for promotional and commercial purposes across any media platform now known or developed in the future. I waive any right to royalties or compensation.


9. Governing Law & Severability

This Agreement shall be governed by and construed in accordance with the laws of the State of Tennessee. If any part of this waiver is found unenforceable, the remaining provisions shall remain in full force and effect.


10. Acknowledgement & Signature

I have read and understood this waiver. I voluntarily agree to all terms, with the intent to release the Organizer from any and all liability now and in the future, regardless of business structure, nonprofit status, or involvement in organizing the event. I understand that by signing, I am giving up substantial legal rights.
