PLEASE READ THESE TERMS AND CONDITIONS CAREFULLY BEFORE BOOKING A TRIP WITH VOYUMAR. BY MAKING A BOOKING, YOU ACKNOWLEDGE THAT YOU HAVE READ, UNDERSTOOD, AND AGREE TO BE BOUND BY THESE TERMS, WHICH CONSTITUTE A LEGALLY BINDING AGREEMENT BETWEEN YOU AND VOYUMAR INC. ("VOYUMAR," "WE," "US," OR "OUR").

1. Definitions

· "Trip": The accompanied travel package, tour, or experience offered by Voyumar, as described in the itinerary.
· "Participant," "Traveller," "You," "Your": All persons named on the booking, including any minors, and anyone added or substituted at a later date.
· "Accompanying Guide": The Voyumar-employed or contracted representative who accompanies the group for the duration of the Trip.
· "Itinerary": The proposed daily schedule for the Trip provided by Voyumar. It is subject to change as outlined herein.
· "Booking Form": The official Voyumar form completed by the Participant to reserve a Trip.
· "Total Price": The total cost of the Trip as outlined in the invoice.

2. Booking and Payment

· Booking: A booking is confirmed once Voyumar receives a completed Booking Form, a non-refundable deposit per person (as specified on the invoice), and signed acceptance of these Terms.
· Payment Schedule: The remaining balance of the Total Price must be paid no later than 90 days prior to the Trip departure date. If the booking is made within 90 days of departure, the full Total Price is due at the time of booking.
· Late Payment: Failure to make payment in full by the due date may be treated as a cancellation by you, and cancellation fees will apply.
· Price Guarantee: The Total Price is guaranteed upon receipt of your full payment, except for potential increases due to government-imposed taxes, fees, or fuel surcharges, which may be passed on to the Participant.

3. Prices and Inclusions

· The Total Price Includes: Accommodations, transportation (as specified in the itinerary), services of an Accompanying Guide, meals as listed (B=Breakfast, L=Lunch, D=Dinner), entrance fees to included attractions, and gratuities for included services (e.g., local guides, drivers).
· The Total Price Excludes: Airfare (unless explicitly stated), travel insurance, passports/visas, beverages with meals unless otherwise stated, items of a personal nature (laundry, phone calls, etc.), baggage fees, and gratuities for the Accompanying Guide (which are discretionary).

4. Cancellations and Refunds by Participant

All cancellations must be received by Voyumar in writing. The cancellation date is the date Voyumar receives the written notice. Cancellation fees are calculated as follows:

· 90+ days before departure: Loss of deposit.
· 89-60 days before departure: 50% of Total Price forfeited.
· 59-30 days before departure: 75% of Total Price forfeited.
· 29 days or less before departure: 100% of Total Price forfeited.

We strongly recommend that all Participants purchase comprehensive travel insurance with cancellation coverage at the time of booking.

5. Changes and Cancellations by Voyumar

· Minimum Participation: Voyumar requires a minimum number of Participants to operate a Trip. If the minimum is not met, we reserve the right to cancel the Trip no later than 30 days prior to departure. In this case, a full refund of all monies paid will be issued, which will constitute full settlement.
· Force Majeure: Voyumar is not liable for failure to perform its obligations if such failure is due to unforeseen circumstances beyond its reasonable control, including but not limited to acts of God, war, terrorism, civil unrest, pandemics, government restrictions, natural disasters, or significant transportation failures. In such events, Voyumar may, at its sole discretion:
  · Offer a credit for a future Trip.
  · Postpone the Trip to a later date.
  · Proceed with a modified itinerary.
  · If the Trip is cancelled, refunds will be provided less any unrecoverable costs paid to third-party suppliers (e.g., hotels, operators). This refund may be partial.
· Itinerary Changes: Voyumar reserves the right to modify itineraries, accommodations, transportation, or the order of activities due to safety, weather, operational constraints, or other factors. We will make reasonable efforts to provide substitutes of equal quality. Such changes do not constitute a breach of contract and are not grounds for a refund.

6. Participant Responsibilities

· Travel Documents: You are solely responsible for obtaining and possessing a valid passport, necessary visas, vaccinations, and any other required travel documents for all countries on your itinerary.
· Travel Insurance: Travel insurance is mandatory for all Voyumar Participants. You must provide proof of a comprehensive policy that includes emergency medical, evacuation, repatriation, and cancellation coverage. Voyumar is not responsible for any costs incurred due to lack of insurance.
· Health and Conduct: You must ensure you are physically and mentally fit for the Trip. You are expected to comply with all local laws and regulations and follow the instructions of the Accompanying Guide. Voyumar reserves the right to terminate your participation, without refund, if your behaviour is deemed to be disruptive, dangerous, or illegal. You will be responsible for all costs associated with early termination and return travel.

7. Limitations of Liability

· Third-Party Suppliers: Voyumar acts as an intermediary in arranging services with independent third-party suppliers (hotels, carriers, local guides, etc.). We exercise care in selecting these suppliers but are not responsible for their acts, omissions, negligence, or failures, whether beyond our control or not.
· Assumption of Risk: Participation in a Voyumar Trip involves inherent risks, including but not limited to accidents in remote locations, illness, forces of nature, and travel in unfamiliar environments. By booking this Trip, you voluntarily assume all such risks.
· Limitation of Damages: To the fullest extent permitted by law, Voyumar's maximum liability for any claim relating to a Trip is limited to the amount paid for the Trip. In no event shall Voyumar be liable for any indirect, consequential, incidental, special, or punitive damages.

8. Medical Authorisation and Privacy (For Minors)

· If the Participant is a minor, the parent/legal guardian hereby authorises the Accompanying Guide to make medical decisions for the minor in case of an emergency, to the fullest extent permitted by law, if the parent/guardian cannot be reached in a timely manner.
· Voyumar collects personal data to facilitate the booking. By booking, you consent to our sharing this data with necessary third-party suppliers (e.g., airlines, hotels). Our full Privacy Policy is available on our website.

9. Claims and Disputes

· Any claim must be reported to the Accompanying Guide during the Trip to allow for on-the-spot resolution. If not resolved, a written claim must be submitted to Voyumar within 30 days of the Trip's completion.
· These Terms shall be governed by the laws of the UK. Any dispute arising from these Terms or a Voyumar Trip shall be resolved exclusively through binding arbitration in London UK, rather than in court.

10. Acceptance

By signing the Booking Form or clicking "I Agree" online, you affirm that you are authorised to do so on behalf of all persons named on the booking and that you have read and agree to these Terms and Conditions on their behalf.
