The Service Provider agrees to create a DJ edit based on the Client’s submitted track(s).
2. Intended Use
All edits provided by the Service Provider are strictly for the Client’s personal use. Redistribution, resale, or any commercial use of the edited track(s) by the Client is strictly prohibited.
Fauve Records Usage
By default, all completed edits are eligible to be used as one-off releases for Fauve Records, unless the "Exclusivity" service is selected. Selecting "Exclusivity" ensures that the edit will not be shared, released, or used in any way other than by the Client.
The Client acknowledges and agrees that:
If the "Exclusivity" service is not selected, Fauve Records reserves the right to use the edit as part of its catalog. The Client will be informed of any potential usage of the edit for Fauve Records releases. By engaging in this service without the "Exclusivity" add-on selected, the Client waives any right to dispute or disclose the Service Provider’s use of the edit.
3. Original Track Ownership
The Client acknowledges that they hold or have secured the appropriate rights to the track(s) submitted for editing. The Service Provider is not liable for any copyright infringement issues resulting from the Client’s submission.
4. Client Responsibilities
If the "Record Hunting" service is not selected, the Client is responsible for providing a legitimate copy of the track(s) for editing. Submitted files must be:A high-quality vinyl RIP (AIFF, WAV, or FLAC format), and in stereo, 16-bit resolution, with a 44.1kHz or higher sample rate.
5. Delivery and Payment
• Payment must be completed via PayPal upon submission and approval of the request.
• Edits will be delivered electronically within 2 week of the request's acceptance.
• The delivery will be given in 16-bit resolution, with a 44.1kHz sample rate.
6. Legal Disclaimer
• The Service Provider assumes no responsibility for the legal status of the original track(s) provided by the Client.
• The Client agrees to indemnify and hold harmless the Service Provider against any claims or liabilities arising from the use of the edited track(s).
7. Limitation of Liability
The Service Provider’s liability is limited to the amount paid by the Client for the service.
8. Service Limitation
The client understands that the Service Provider assumes no responsibility for the legal status of the original track(s) I provide."
9. Payment Agreement
The client agrees to make full payment via PayPal or transfer upon approval of my request. I understand that the service will only commence after payment is received."
10. Refund Policy
All payments made are non-refundable once the editing process has begun. Clients are encouraged to carefully review their requests before submitting.
11. Delivery Timeframe
The client understand that edits will be delivered within 1 week of the request's acceptance unless otherwise communicated."
12. Legal Indemnity
The client agrees to indemnify and hold the Service Provider harmless from any legal claims or liabilities arising from my use of the edited track(s)."
13. Binding Agreement Confirmation
By submitting a track for editing and filling out the form, the Client acknowledges and agrees to the terms outlined in this Agreement.
14. Revisions
The Client is entitled to a maximum of three (3) revisions per edit. Revisions are limited to adjustments within the scope of the originally requested services. Any additional revisions beyond this limit will incur an extra fee, which will be communicated prior to proceeding.
15. Privacy and Confidentiality
The Client's name and personal details will remain strictly private and confidential. This information will be used solely for the purpose of providing the requested services and will not be shared, sold, or disclosed to any third party under any circumstances.
16. Force Majeure
The Service Provider shall not be held responsible for delays or failure to fulfill the service due to circumstances beyond their control, including but not limited to technical issues, natural disasters, or other unforeseen events.
17. Quality Guarantee
While every effort will be made to deliver edits to the highest quality standards, the Service Provider cannot guarantee specific results due to the variable quality of source materials provided by the Client.
18. Service Adjustments
The Service Provider reserves the right to make adjustments to service offerings, pricing, or availability. Clients will be notified of any such changes in advance
