Ich verarbeite personenbezogene Daten nur, soweit das für die Bearbeitung von Anfragen und die Kommunikation mit Interessenten erforderlich ist. Es findet keine automatisierte Entscheidungsfindung und kein Profiling statt.
3. Projektformular (Tally)
Welche Daten: Wenn Sie das Projektformular ausfüllen, verarbeite ich Ihre Angaben: Name, E-Mail-Adresse, Wohnort (Stadt, Land), Selbstbeschreibung (z. B. Solokünstler oder Band), Links zu bisherigen Werken, Ziele und Beschreibung Ihres Projekts, gewünschte Leistungen, Budgetrahmen und optional, wie Sie auf mich aufmerksam geworden sind. Ohne die Pflichtangaben kann ich Ihre Anfrage nicht bearbeiten.
Zweck und Rechtsgrundlage: Die Daten dienen der Bearbeitung und Beantwortung Ihrer Anfrage und ggf. der Vorbereitung eines Angebots. Rechtsgrundlage ist Art. 6 Abs. 1 lit. b DSGVO (vorvertragliche Maßnahmen auf Ihre Anfrage), ergänzend Art. 6 Abs. 1 lit. f DSGVO (mein berechtigtes Interesse an der Bearbeitung von Anfragen).
Dienstleister: Das Formular wird mit dem Dienst Tally bereitgestellt (Tally BV, Sint-Pietersnieuwstraat 11, 9000 Gent, Belgien). Tally verarbeitet die Formulardaten als Auftragsverarbeiter in meinem Auftrag, ein Auftragsverarbeitungsvertrag besteht. Nach Angaben von Tally werden Formulardaten in der EU gespeichert (Hosting: Google Cloud, Belgien) und verschlüsselt übertragen und gespeichert. Für den Versand der E-Mail-Benachrichtigung an mich setzt Tally nach eigenen Angaben den Dienstleister SendGrid (USA) ein. Tally verpflichtet sich in seinem Auftragsverarbeitungsvertrag, Daten außerhalb des Europäischen Wirtschaftsraums nur auf Grundlage von Standardvertragsklauseln oder anderer nach der DSGVO vorgesehener Mechanismen zu übermitteln. Ihre Anfrage erreicht mich per E-Mail, und ich antworte per E-Mail. Für mein Postfach nutze ich einen Dienst von Google (Gmail, Google Ireland Limited, Gordon House, Barrow Street, Dublin 4, Irland). Dabei werden Ihre E-Mail-Adresse, der Inhalt der Nachrichten und Verbindungsdaten verarbeitet. Daten können dabei auch in Drittländern, insbesondere den USA, verarbeitet werden. Rechtsgrundlage ist Art. 6 Abs. 1 lit. b DSGVO, hilfsweise Art. 6 Abs. 1 lit. f DSGVO (effiziente Kommunikation mit Interessenten).
In meinen Profilen verlinke ich eine Übersichtsseite des Dienstes Linktree. Beim Aufruf dieser Seite verarbeitet Linktree nach eigenen Angaben unter anderem technische Daten wie Ihre IP-Adresse, den ungefähren Standort und Nutzungsdaten, und zwar in eigener Verantwortung. Weitere Informationen in der Datenschutzerklärung von Linktree: https://linktr.ee/s/privacy. Auf der Übersichtsseite setze ich keine Tracking- oder Pixel-Funktionen ein. Rechtsgrundlage für die Verlinkung ist Art. 6 Abs. 1 lit. f DSGVO (mein Interesse an einer übersichtlichen Präsentation meines Angebots).
6. Profile auf Instagram und TikTok
Ich betreibe Profile auf Instagram und TikTok. Informationen zur Datenverarbeitung auf diesen Profilen finden Sie weiter unten im Abschnitt „Datenschutzhinweis für meine Social-Media-Profile“.
Ich lösche Ihre Anfrage, sobald sie abschließend bearbeitet ist und kein Auftrag zustande kommt, spätestens nach sechs Monaten. Kommt ein Auftrag zustande, speichere ich Ihre Daten so lange, wie das für die Durchführung des Auftrags und wegen gesetzlicher Aufbewahrungspflichten (z. B. nach Handels- und Steuerrecht) erforderlich ist.
Sie haben nach der DSGVO das Recht auf Auskunft (Art. 15), Berichtigung (Art. 16), Löschung (Art. 17), Einschränkung der Verarbeitung (Art. 18) und Datenübertragbarkeit (Art. 20). Soweit die Verarbeitung auf Art. 6 Abs. 1 lit. f DSGVO beruht, können Sie ihr aus Gründen, die sich aus Ihrer besonderen Situation ergeben, widersprechen (Art. 21). Zur Ausübung Ihrer Rechte schreiben Sie mir an die oben genannte E-Mail-Adresse.
Sie haben außerdem das Recht, sich bei einer Datenschutz-Aufsichtsbehörde zu beschweren, insbesondere in dem Mitgliedstaat Ihres gewöhnlichen Aufenthaltsorts, Ihres Arbeitsplatzes oder des Orts des mutmaßlichen Verstoßes (Art. 77 DSGVO).
Datenschutzhinweis für meine Social-Media-Profile (Instagram, TikTok, Linktree)
1. Für welche Profile gilt dieser Hinweis?
Dieser Hinweis gilt für meine Profile bei Instagram (
instagram.com/erickrause.music), TikTok (
tiktok.com/@erickrause.music) und Linktree (
linktr.ee/erickrause.music). Verantwortlicher bin ich, Eric Krause, Kontaktdaten siehe oben. Für das Projektformular gilt die allgemeine Datenschutzerklärung weiter oben.
2. Was passiert beim Besuch meiner Profile?
Die Plattformen erheben beim Besuch selbst Daten, zum Beispiel Ihre IP-Adresse, Geräte- und Browserinformationen, Cookie-Kennungen und Ihr Nutzungsverhalten. Das kann auch passieren, wenn Sie nicht eingeloggt sind oder kein Konto haben. Sind Sie eingeloggt, können die Plattformen Ihren Besuch Ihrem Konto zuordnen. Nach eigenen Angaben nutzen sie diese Daten unter anderem für personalisierte Werbung, Statistiken und die Weiterentwicklung ihrer Dienste. Auf diese Verarbeitung habe ich keinen Einfluss und keinen Zugriff auf die Einzeldaten.
Die Daten können in Länder außerhalb der EU übermittelt werden, insbesondere in die USA. Die Plattformen stützen sich dafür nach eigenen Angaben auf Angemessenheitsbeschlüsse der EU-Kommission oder auf EU-Standardvertragsklauseln. Ein gleichwertiges Schutzniveau wie in der EU ist dabei nicht in jedem Fall garantiert. 3. Die Plattformen im Einzelnen
Instagram: Anbieter ist Meta Platforms Ireland Limited, Merrion Road, Dublin 4, D04 X2K5, Irland („Meta“). Für die Statistiken zu meinem Profil (Insights) sind Meta und ich gemeinsam verantwortlich nach Art. 26 DSGVO. Die Vereinbarung finden Sie hier:

TikTok: Anbieter ist TikTok Technology Limited, The Sorting Office, Ropemaker Place, Dublin 2, D02 HD23, Irland („TikTok“). Soweit TikTok mir Statistiken zu meinem Profil bereitstellt (TikTok Analytics), sind TikTok und ich dafür gemeinsam verantwortlich nach Art. 26 DSGVO. Die Vereinbarung finden Sie hier:

Linktree: Anbieter ist Linktree Pty Ltd, 1-9 Sackville Street, Collingwood VIC 3066, Australien. EU-Vertreter nach Art. 27 DSGVO: Instant EU GDPR Representative Ltd., Office 2, 12A Lower Main Street, Lucan Co. Dublin, K78 X5P8, Irland. Beim Aufruf meiner Linktree-Seite erfasst Linktree in eigener Verantwortung unter anderem IP-Adresse, Gerätedaten, die Seite, von der Sie kommen, und welche Links Sie anklicken. Ich sehe davon nur zusammengefasste Statistiken, zum Beispiel wie oft ein Link geklickt wurde. Linktree übermittelt Daten nach eigenen Angaben nach Australien und in die USA und nutzt dafür, wo nötig, EU-Standardvertragsklauseln. Mehr dazu:

4. Welche Daten verarbeite ich selbst?
Ich verarbeite nur, was Sie mir über die Plattformen selbst zeigen oder schicken, und die zusammengefassten Statistiken der Plattformen.
Nachrichten und Projektanfragen an mich: Benutzername, Profilbild, Inhalt der Nachricht, gegebenenfalls Kontaktdaten. Rechtsgrundlage ist bei Projektanfragen Art. 6 Abs. 1 lit. b DSGVO (vorvertragliche Maßnahmen), sonst Art. 6 Abs. 1 lit. f DSGVO (mein Interesse, mit meinem Publikum zu kommunizieren). Speicherdauer: bis die Anfrage erledigt ist. Kommt ein Auftrag zustande, gelten die gesetzlichen Aufbewahrungsfristen (z. B. sechs Jahre für Geschäftsbriefe nach § 147 AO).
Öffentliche Interaktionen (Likes, Kommentare, Markierungen, Erwähnungen): Benutzername und Inhalt. Rechtsgrundlage ist Art. 6 Abs. 1 lit. f DSGVO (Austausch mit meinem Publikum). Speicherdauer: solange sie auf der Plattform sichtbar sind, Sie können sie jederzeit selbst löschen. Rechtswidrige oder beleidigende Kommentare lösche ich.
Statistiken (Instagram Insights, TikTok Analytics, Linktree): Nur zusammengefasste, anonyme Werte, keine Einzelpersonen. Rechtsgrundlage ist Art. 6 Abs. 1 lit. f DSGVO (mein Interesse, die Reichweite meiner Inhalte zu verstehen und zu verbessern). Ich speichere keine personenbezogenen Einzeldaten daraus.
Wenn ich Sie als Artist anschreibe: Künstlername, Profil-Links, öffentlich veröffentlichte Musik und Profilangaben. Quelle sind öffentliche Profile auf Spotify, Instagram und TikTok. Rechtsgrundlage ist Art. 6 Abs. 1 lit. f DSGVO (mein Interesse, mit passenden Artists in Kontakt zu kommen). Speicherdauer: bis Sie widersprechen oder kein Kontakt zustande kommt, spätestens nach 12 Monaten.
Sie haben das Recht auf Auskunft (Art. 15 DSGVO), Berichtigung (Art. 16), Löschung (Art. 17), Einschränkung der Verarbeitung (Art. 18) und Datenübertragbarkeit (Art. 20). Schreiben Sie mir dazu an erickrause.music@gmail.com.
Widerspruchsrecht (Art. 21 DSGVO): Soweit ich Daten auf Grundlage meines berechtigten Interesses verarbeite (Art. 6 Abs. 1 lit. f DSGVO), können Sie dem jederzeit aus Gründen widersprechen, die sich aus Ihrer besonderen Situation ergeben. Wenn ich Sie als Artist anschreibe, reicht ein formloses „Nein danke“, dann lösche ich Ihre Daten aus meiner Kontaktliste.
Bei den gemeinsam verantwortlichen Verarbeitungen (Instagram Insights, TikTok Analytics) können Sie sich an mich oder an die Plattform wenden. Anfragen, die nur die Plattform erfüllen kann, leite ich an sie weiter. Sie können sich außerdem bei einer Datenschutz-Aufsichtsbehörde beschweren, insbesondere in dem Mitgliedstaat Ihres gewöhnlichen Aufenthaltsorts, Ihres Arbeitsplatzes oder des Orts des mutmaßlichen Verstoßes (Art. 77 DSGVO).
Sie sind nicht verpflichtet, mir Daten zu geben. Ohne Nachricht kann ich auf eine Anfrage aber nicht antworten. Eine automatisierte Entscheidungsfindung oder ein Profiling durch mich findet nicht statt. Ich passe diesen Hinweis an, wenn sich meine Profile oder die Bedingungen der Plattformen ändern.

I process personal data only as far as necessary to handle inquiries and to communicate with prospective clients. There is no automated decision-making and no profiling.
What data: When you fill in the project form, I process the details you enter: name, email address, location (city, country), self-description (e.g. solo artist or band), links to previous work, goals and description of your project, requested services, budget range and, optionally, how you found out about me. Without the required fields I cannot process your inquiry.
Purpose and legal basis: The data is used to process and answer your inquiry and, where applicable, to prepare an offer. The legal basis is Art. 6(1)(b) GDPR (steps prior to entering into a contract at your request), supplemented by Art. 6(1)(f) GDPR (my legitimate interest in handling inquiries).
Service provider: The form is provided by Tally (Tally BV, Sint-Pietersnieuwstraat 11, 9000 Ghent, Belgium). Tally processes the form data as a processor on my behalf, and a data processing agreement is in place. According to Tally, form data is stored in the EU (hosting: Google Cloud, Belgium) and is encrypted in transit and at rest. To send the email notification to me, Tally states that it uses the service provider SendGrid (USA). In its data processing agreement, Tally commits to transferring data outside the European Economic Area only on the basis of standard contractual clauses or other mechanisms provided for by the GDPR. Your inquiry reaches me by email, and I reply by email. For my mailbox I use a service provided by Google (Gmail, Google Ireland Limited, Gordon House, Barrow Street, Dublin 4, Ireland). This involves processing your email address, the content of the messages and connection data. Data may also be processed in third countries, in particular the USA. The legal basis is Art. 6(1)(b) GDPR and, alternatively, Art. 6(1)(f) GDPR (efficient communication with prospective clients).
In my profiles I link to an overview page provided by Linktree. When you open this page, Linktree states that it processes, among other things, technical data such as your IP address, approximate location and usage data, under its own responsibility. More information is available in Linktree's privacy notice: https://linktr.ee/s/privacy. I do not use any tracking or pixel functions on the overview page. The legal basis for the link is Art. 6(1)(f) GDPR (my interest in presenting my services clearly).
6. Profiles on Instagram and TikTok
I operate profiles on Instagram and TikTok. Information on the data processing on these profiles can be found further below in the section “Privacy notice for my social media profiles”.
I delete your inquiry as soon as it has been dealt with and no contract is concluded, at the latest after six months. If a contract is concluded, I store your data for as long as is necessary to perform the contract and to comply with statutory retention obligations (e.g. under commercial and tax law).
Under the GDPR you have the right of access (Art. 15), rectification (Art. 16), erasure (Art. 17), restriction of processing (Art. 18) and data portability (Art. 20). Where the processing is based on Art. 6(1)(f) GDPR, you may object to it on grounds relating to your particular situation (Art. 21). To exercise your rights, please write to me at the email address above.
You also have the right to lodge a complaint with a data protection supervisory authority, in particular in the Member State of your habitual residence, place of work or place of the alleged infringement (Art. 77 GDPR).

Privacy notice for my social media profiles (Instagram, TikTok, Linktree)
1. Which profiles does this notice cover?
This notice covers my profiles on Instagram (
instagram.com/erickrause.music), TikTok (
tiktok.com/@erickrause.music) and Linktree (
linktr.ee/erickrause.music). I, Eric Krause, am the controller, see contact details above. The project form is covered by the general privacy policy above.
2. What happens when you visit my profiles?
The platforms themselves collect data when you visit, for example your IP address, device and browser information, cookie identifiers and your usage behaviour. This can happen even if you are not logged in or do not have an account. If you are logged in, the platforms can link your visit to your account. According to their own statements, they use this data for personalised advertising, statistics and the development of their services, among other things. I have no influence on this processing and no access to the individual data.
The data may be transferred to countries outside the EU, in particular the USA. According to their own statements, the platforms rely on adequacy decisions of the EU Commission or on EU standard contractual clauses for this. A level of protection equivalent to the EU is not guaranteed in every case. If you want to avoid this, you can view my content while logged out, delete cookies or contact me directly by email.

When you open my Linktree page, Linktree collects, under its own responsibility, among other things your IP address, device data, the page you come from and which links you click. 4. What data do I process myself?
I only process what you show or send me through the platforms yourself, and the aggregated statistics provided by the platforms.
Messages and project inquiries to me: Username, profile picture, content of the message, and contact details where applicable. The legal basis for project inquiries is Art. 6(1)(b) GDPR (steps prior to entering into a contract), otherwise Art. 6(1)(f) GDPR (my interest in communicating with my audience). Storage period: until the inquiry has been dealt with. If a contract is concluded, statutory retention periods apply (e.g. six years for business letters under Section 147 of the German Fiscal Code).
Public interactions (likes, comments, tags, mentions): Username and content. The legal basis is Art. 6(1)(f) GDPR (exchange with my audience). Storage period: as long as they are visible on the platform, and you can delete them yourself at any time. I delete unlawful or insulting comments.
Statistics (Instagram Insights, TikTok Analytics, Linktree): Only aggregated, anonymous values, no individuals. The legal basis is Art. 6(1)(f) GDPR (my interest in understanding and improving the reach of my content). I do not store any individual personal data from them.
When I contact you as an artist: Artist name, profile links, publicly released music and profile information. The source is public profiles on Spotify, Instagram and TikTok. The legal basis is Art. 6(1)(f) GDPR (my interest in getting in touch with suitable artists). Storage period: until you object or no contact is established, at the latest after 12 months.
You have the right of access (Art. 15 GDPR), rectification (Art. 16), erasure (Art. 17), restriction of processing (Art. 18) and data portability (Art. 20). Please write to me at erickrause.music@gmail.com.
Right to object (Art. 21 GDPR): Where I process data on the basis of my legitimate interest (Art. 6(1)(f) GDPR), you can object at any time on grounds relating to your particular situation. If I contact you as an artist, an informal “No thanks” is enough, and I will delete your data from my contact list.
For the joint controller processing (Instagram Insights, TikTok Analytics), you can turn to me or to the platform. I forward requests that only the platform can fulfil. You can also lodge a complaint with a data protection supervisory authority, in particular in the Member State of your habitual residence, place of work or place of the alleged infringement (Art. 77 GDPR).
You are not obliged to give me any data. Without a message, however, I cannot answer an inquiry. There is no automated decision-making and no profiling by me. I will adjust this notice if my profiles or the platforms' terms change.
