THE WELLHAUS LLC SAUNA USAGE WAIVER AND RELEASE OF LIABILITY

ACKNOWLEDGMENT OF RISKS

I understand that the use of a sauna involves certain inherent risks, including but not limited to dehydration, overheating, dizziness, fainting, or other physical discomforts. I acknowledge that I have been advised to consult with a healthcare professional before using the sauna, particularly if I have any medical conditions such as heart disease, high or low blood pressure, pregnancy, or if I am taking medications that could be affected by heat exposure.

HEALTH DISCLOSURE

I confirm that I do not have any medical conditions, illnesses, or injuries that would make the use of the sauna unsafe. I further confirm that I am not under the influence of alcohol, drugs, or any other substances that could impair my ability to safely use the sauna.

ASSUMPTION OF RISK AND VOLUNTARY PARTICIPATION

I voluntarily choose to use the sauna and expressly assume all risks associated with its use, including but not limited to dehydration, overheating, dizziness, fainting, or any other physical discomfort or injuries that may arise. I acknowledge that while The Wellhaus has implemented reasonable safety measures to mitigate risks, it cannot guarantee the prevention of all unforeseen incidents or injuries. By using the sauna, l accept full responsibility for my decision and agree to take necessary precautions, including but not limited to staying hydrated, adhering to time limits, and following all instructions and guidelines provided.

LIABILITY WAIVER AND RELEASE

In consideration of being allowed to use the sauna, I, on behalf of myself, my heirs, executors, and assigns, hereby release and discharge The Wellhaus, its owners, employees, agents, and affiliates from any and all claims, demands, or causes of action arising out of or related to my use of the sauna, except in cases of gross negligence or intentional misconduct.

ACKNOWLEDGMENT OF POLICIES

I agree to strictly adhere to all rules, policies, and guidelines provided by The Wellhaus, including but not limited to time limits, hygiene requirements, and any instructions or directives issued by staff members. I acknowledge that these policies are designed to ensure the safety, comfort, and well-being of all participants. I further understand and accept that any failure, whether intentional or unintentional, to comply with these policies may result in the immediate suspension or permanent termination of my access to the sauna and other related facilities, without any refund or recourse.

EMERGENCY PROCEDURES

If you experience any discomfort, dizziness, or distress while using the sauna, immediately exit the sauna and notify a staff member for assistance. The Wellhaus will provide support, including cooling measures, hydration, or calling for emergency medical services if necessary. Familiarize yourself with the sauna's emergency exits and safety protocols prior to use. Guests are encouraged to take precautions such as staying hydrated, adhering to recommended time limits, and following all provided guidelines to ensure a safe experience. Staff are available to address concerns and guide participants in the event of an emergency.

SAUNA ADA EXEMPTION

At The Wellhaus, we are committed to creating a welcoming environment for all guests. However, it is important to understand that saunas, as specialized wellness facilities, may be exempt from certain Americans with Disabilities Act (ADA) accessibility requirements. This exemption is based on specific factors outlined under ADA regulations.

Specifically:

1. Saunas are typically small, enclosed spaces with unique design and operational features, such as high temperatures and humidity levels, that may not accommodate certain modifications without compromising the intended functionality or safety of the facility.

2. The nature of sauna use involves inherent risks, such as heat exposure, which may pose additional hazards for individuals with certain medical conditions or disabilities. To maintain the safety of all patrons, some features may not be compatible with ADA standards.

3. Under ADA guidelines, specific structures and spaces are exempt if making modifications would fundamentally alter the nature of the service provided, impose undue burdens, or compromise essential design and safety features.

While saunas may fall under these exemptions, The Wellhaus strives to make reasonable efforts to accommodate individuals with disabilities in other areas of our facility and services where possible.
