Welcome to the journey! This agreement sets out what we can expect from each other during our coaching relationship. At Emberwell, our goal is "Burning Brighter, without burning out" and this document helps make sure our foundation is solid.
1. The Relationship between Client and Coach
1.1. As your Life Coach, Eric Sagal (doing business as Emberwell Coaching, referred to here as "Coach") will partner with you on a journey of discovery, self-exploration, accountability, and follow-through. My job is to help you discover your path, create a plan, and reach your goals. I’ll help you uncover any beliefs or issues that might be blocking your progress.
1.2. Disclaimer of Results: While I am fully committed to your growth, you are the driver of your own life. Success depends on your own engagement, effort, and follow-through with the plans we set together. Therefore, the Coach does not guarantee specific outcomes or results.
1.3. AI Disclosure: While Emberwell may utilize advanced technological tools and AI to assist in data organization, research, or drafting, all final deliverables, coaching advice, and strategic frameworks are rigorously reviewed, validated, and finalized by a human coach to ensure accuracy, empathy, and professional integrity.
2. Term of Service
2.1. Real growth takes time. To allow for meaningful change, you agree to commit to the duration of the coaching package you’ve selected.
2.2. Either of us can end the coaching relationship at any time. We just ask for one final session to wrap things up and settle any outstanding fees. Any unused, pre-paid fees will be refunded to you.
3. Scheduled Sessions & Late Arrivals
3.1. Sessions are 60 minutes long, held virtually via Zoom at our agreed-upon time. The standard rate is $150 per session, though packages offer a lower rate.
3.2. Late Arrivals: If you’re running late, please let me know! We will still end the session at the originally scheduled time to stay on track for other clients, and the full session fee will apply.
4. Cancellation & Rescheduling
4.1. Life happens, but please give at least 24 hours' notice if you need to cancel. If notice is given less than 24 hours in advance, the regular session fee will apply.
4.2. If you reach out more than 24 hours ahead of time, we’ll simply find a new time that works for both of us to reschedule.
5. Additional Support
5.1. Sometimes you need a quick check-in. Unscheduled calls or extra sessions beyond a 15-minute grace period will be billed at $200 for 60 minutes (pro-rated at $50 per 15 minutes).
6. Intellectual Property
6.1. Any worksheets, frameworks, or materials I share with you are the property of Emberwell Coaching. They are for your personal use only—please don’t share, sell, or use them for commercial purposes without my written “okay."
7. Confidentiality & Privacy
7.1. Your identity and everything we discuss is strictly confidential. The only exceptions are if the law requires disclosure (such as if there’s a risk of harm to yourself or others).
7.2. Data Privacy: I value your privacy. Your contact info and session notes are stored securely and used only for our coaching relationship.
8. Payment Method
8.1. Fees are payable in advance of services via ZenBusiness Invoicing (Stripe), CashApp, or Zelle. Coaching sessions won't begin until payment is received.
9. Liability & Professional Boundaries
9.1. Emberwell Coaching and its team are not medical or psychological professionals. Coaching is not a substitute for psychotherapy or medical treatment.
9.2. If a situation arises where medical or psychological help is needed, I am ethically and legally bound to refer you to a licensed professional.
10. Governing Law & Dispute Resolution
10.1. This agreement is governed by the laws of the State of Texas.
10.2. If we ever have a disagreement we can’t resolve together, we agree to try mediation in Denton County, Texas, before taking any formal legal action. This keeps things friendly and focused on finding a solution.
Growth Concierge Addendum
This Addendum is an agreement between Eric Sagal (doing business as Emberwell Coaching) and the Client. It supplements the primary Coaching Agreement for the 'Momentum Month' or 'Inspired Growth Journey' packages.
1. Scope of Service
The "Growth Concierge" provides unlimited text and email support between scheduled coaching sessions. This service is intended for brief check-ins, mindset shifts, and momentum-building. It is not a substitute for full coaching sessions or professional mental health services.
2. Availability and Response Times
While the Client may send messages at any time, Eric Sagal will respond during business hours (Monday-Friday, 9:00 AM - 7:00 PM CT). The standard response time is within 24 business hours. Response times may vary during holidays or pre-announced breaks.
3. Not Therapy or Crisis Support
The Growth Concierge is for life and career coaching only. It is NOT a crisis intervention service or a substitute for therapy.
Emergency Protocol: If the Client is experiencing a mental health crisis or emergency, they must contact 911 or the 988 Suicide & Crisis Lifeline immediately.
Referral: If Eric Sagal determines that a Client's needs exceed the scope of life coaching, he reserves the right to refer the Client to a licensed mental health professional and may pause the Concierge service.
4. Reasonable Use Policy ("Fair Use")
"Unlimited" is defined as reasonable use that does not impede Eric Sagal’s ability to serve other clients or manage his own professional capacity (in alignment with the "burn brighter without burning out" philosophy). If message volume becomes excessive (e.g., interfering with daily operations), Eric Sagal reserves the right to set a daily message cap or move discussions to a scheduled session.
5. Privacy and Security Warning
The Client acknowledges that while WhatsApp offers end-to-end encryption, standard SMS (text) is not a secure or encrypted form of communication.
Assumption of Risk: By choosing to communicate via WhatsApp or SMS, the Client accepts the inherent privacy risks associated with these platforms.
Confidentiality: Emberwell Coaching will maintain the same level of confidentiality for digital messages as it does for sessions, subject to legal requirements and safety disclosures.
6. Termination
This service remains active for the duration of the Client’s coaching package and terminates upon the conclusion of the final session unless a renewal or maintenance package is purchased.
11. Entire Agreement
11.1. This document is the whole deal. Any changes to this agreement must be made in writing and signed by both of us.
