Purpose: This Release/Waiver is prepared by Lu’uLive LLC (“Lu’u” or the “Company”) to inform all volunteers who contribute videography or photography ("Footage") to Lu’u that Lu’u, its owners, members, managers, and consultants, including Matthew Feeley, disclaim liability for any incidents, accidents, injuries, or damages that may occur or arise from the volunteer’s activities. Please read it carefully. Only sign if you understand and agree.
Background: Lu’u is a development stage company focused on ocean forecasting. It has no employees, no revenues, no insurance, and minimal assets. Volunteer Role and Compensation: A volunteer is an unpaid independent contractor and is not employed by Lu’u. The Company has limited resources and therefore volunteers will not receive monetary compensation. Also Lu’u does not control the volunteer’s schedule or duties. However, in appreciation for accepted Footage, a volunteer will receive credits toward access to Lu’uLive premium features.
Footage Use: By providing Footage to Lu’u, all volunteers release and authorize the use of their photography or videography for Lu’u reports, website, promotional materials, or commercial applications without compensation or attribution.
Assumption of Risk and Waiver (Diving Activities): All volunteers affirm they are aware of the inherent dangers and risks of underwater photography, freediving, scuba, spearfishing and related ocean activities, including, but not limited to, hypoxia, drowning, and death. As they say, “If in doubt, don’t go out” and “think before you swim”. Truly.
All volunteers agree that Lu’uLive LLC and Matthew Feeley (the "Released Parties") will not be held liable for any injury, death, loss or damages resulting from participation in these activities, even if resulting from the negligence of the Released Parties.
All volunteers willingly assume known and unknown risks in connection with the activity. VOLUNTEERS ARE VOLUNTARILY WAIVING ALL LEGAL RIGHTS TO SUE THE RELEASED PARTIES FOR ANYTHING RELATED TO THEIR ALLEGED NEGLIGENCE IN CONJUNCTION WITH DIVING, PHOTOGRAPHY AND RELATED ACTIVITIES.
It is the volunteer's explicit intention to waive, release and disclaim all liability for any property damage, personal injury and/or wrongful death, however caused, INCLUDING, BUT NOT LIMITED TO NEGLIGENCE OF THE RELEASED PARTIES, WHETHER ACTIVE OR PASSIVE.
