1. Scope and Acceptance
These Terms and Conditions (the “Terms”) govern access to the Palm N Pixel Media Pack sales page and the purchase, production and delivery of photography and videography services connected with Marbella Championship 2026 (the “Event”).
The person placing the order is the “Buyer”. The person or team to be covered is the “Athlete”. The Buyer and Athlete may be the same person. If the Buyer purchases for somebody else, Clause 7 applies.
These Terms, the package description displayed at the time of purchase, the order confirmation and any mandatory consumer information supplied at checkout together form the contract. If there is a conflict, the order confirmation and the package description at checkout control the specific deliverables and price; these Terms control the general conditions.
2. Service Provider and Event Organizer

Marbella Fitness Events S.L. / Marbella Championship (“MC26”) is the Event organizer and is not the seller or provider of the Media Pack Service. To the extent permitted by law, MC26 is not responsible for Palm N Pixel’s execution, editing, delivery or service quality. Nothing in this clause excludes any responsibility that cannot lawfully be excluded.
3. Media Pack Options and Contracted Deliverables
Palm N Pixel offers four Media Pack options for athletes. The exact name, price, scope, athlete/team coverage, photo quantity, video inclusion and other deliverables of the selected option are those displayed on the sales page and confirmed in the Buyer’s order.
Where the purchased package states that it includes 12–15 edited action photographs and/or one vertical highlight reel of approximately 20–40 seconds without music, those stated deliverables form part of the contract, subject to these Terms and the live-event limitations below.
Packages are available in limited quantities and may be allocated on a first-come, first-served basis. The Media Pack Team consists of dedicated professional photographers and videographers assigned to registered Media Pack athletes.
Unless the purchased package expressly states otherwise, the service is:
non-exclusive and may be performed alongside coverage of other registered athletes;limited to selected key moments rather than continuous or complete recording;provided during the Athlete’s scheduled Event participation; anddelivered as edited digital content selected by Palm N Pixel.
Raw photographs, raw video, project files, unedited footage, source files, alternate edits and complete heat recordings are not included unless expressly stated in the purchased package.
4. Nature of Live Event Coverage
The Buyer understands that live sports coverage is dynamic, crowded and unpredictable. Capture takes place in real time under changing schedules, lighting, weather, venue, safety, access and competition conditions.
Palm N Pixel does not guarantee:
capture of any particular repetition, movement, result, celebration or interaction;a specific camera angle, background, composition, expression or visual style;continuous recording of a heat, workout or complete performance;equal coverage of every movement or every member of a team; orcoverage that matches a Buyer’s subjective expectations or examples from another athlete.
Palm N Pixel will use reasonable professional efforts to deliver the contracted package. A missed specific moment does not by itself mean that the service was not performed.
5. Athlete Identification and Media Coverage Wristband
Palm N Pixel will provide each registered Media Pack Athlete with an official Media Coverage Wristband for identification purposes.
The Athlete must collect and wear the wristband during every scheduled competition period. It must remain clearly visible so that the Palm N Pixel Media Pack Team can identify the Athlete and provide the purchased coverage.
The Buyer and Athlete are responsible for:
providing the Athlete’s correct full name, competition number, category/division, team name and schedule;checking collection instructions and collecting the wristband on time;wearing the wristband visibly throughout every covered competition period;not exchanging, transferring, concealing, removing, altering or damaging the wristband; andpromptly informing Palm N Pixel of known schedule, category, team or athlete-number changes.
Failure to collect or visibly wear the wristband, or provision of incorrect or incomplete identification details, may result in missed or incomplete coverage and does not entitle the Buyer to a refund, credit, reshoot or replacement service, except where mandatory law requires otherwise.
The wristband assists identification but does not guarantee capture of a particular moment, movement, result or performance.
6. Schedules, Access and Competition Changes
Coverage is planned using schedules and athlete information available to Palm N Pixel. The Event organizer may change heat times, lanes, competition floors, workouts, access routes, safety rules or the Event programme. Palm N Pixel may adapt assignments, positioning and coverage methods accordingly.
The Athlete must comply with Event rules and must not interrupt photographers, videographers, judges or Event operations to request shots during competition. Palm N Pixel personnel retain discretion over safe and authorized camera positions.
7. Orders, Buyer Authority and Contract Formation
A binding contract is formed when:
the Buyer completes the order;payment is successfully authorized; andPalm N Pixel issues an order confirmation.
By ordering, the Buyer confirms that:
they have legal capacity to enter the contract;the order and Athlete information are complete and accurate;they are the Athlete or are authorized by the Athlete to purchase the service and provide the Athlete’s data;they will ensure that the Athlete receives the relevant identification, privacy and service information; andwhere the Athlete is under 18, the Buyer is the Athlete’s parent/legal guardian or has the required authorization.
Palm N Pixel may reject or cancel an order before coverage begins if capacity is unavailable, the order is duplicated, payment is reversed, essential information is missing, or the order cannot lawfully or operationally be fulfilled. Where Palm N Pixel cancels for one of these reasons and does not provide the service, it will return the amount paid unless the cancellation resulted from fraud, chargeback abuse or another lawful ground for withholding payment.
8. Prices, Payment and Invoicing
Prices are those shown at checkout and include applicable taxes unless expressly stated otherwise. Payment is processed by the payment provider identified at checkout. Palm N Pixel does not ordinarily receive or store complete payment-card details.
The Buyer is responsible for reviewing the order before payment. Any invoice request or billing correction must be submitted with the required information within a reasonable time.
9. Right of Withdrawal
Media Pack Services are reserved for a specific Event and performance period. To the extent that the statutory exception for services related to leisure activities with a specific date or period of performance applies, the statutory right of withdrawal does not apply.
Where that exception does not apply, any right of withdrawal is governed by applicable consumer law. Nothing in these Terms requires a consumer to waive a mandatory right that cannot legally be waived. Palm N Pixel will provide any legally required pre-contract information and confirmation through the sales process.
10. Cancellations, Non-Attendance and Refunds
Media Pack purchases reserve limited personnel and production capacity for a specific Athlete or team. Accordingly, purchases are final and non-refundable from the time of confirmation, except where a refund or another remedy is required by mandatory consumer law or expressly provided in this clause.
No refund, whether full or partial, is due because of:
Athlete injury, illness, medical withdrawal or inability to compete;voluntary withdrawal, non-attendance, late arrival or a missed heat;disqualification, removal, penalty or change in competition status;travel disruption, visa issues, transport delay or accommodation problems;a change to the Athlete’s category, team composition, lane, heat or schedule;failure to provide correct Athlete details or communicate a known change;failure to collect or visibly wear the Palm N Pixel Media Coverage Wristband;dissatisfaction because a particular moment, movement, result, angle or preferred image was not captured;weather, venue, crowd, lighting or competition conditions where the service can still reasonably be adapted or performed; orEvent postponement, relocation, interruption, programme reduction or schedule modification where the service is transferred or reasonably adapted.
If the Event is rescheduled, postponed or relocated, Palm N Pixel may transfer the service to the revised Event and adapt the coverage to the revised programme. This does not automatically create a right to a refund.
If the Event is cancelled entirely, or Palm N Pixel is unable to provide the material part of the purchased service, Palm N Pixel will provide the refund, price reduction, credit, transfer or other remedy required by applicable mandatory law. Palm N Pixel may offer an additional discretionary solution, but such an offer does not reduce statutory rights.
No refund is due after the service has been properly performed and the contracted content has been delivered merely because the Buyer changes their mind or dislikes a subjective creative choice.
11. Transfers and Order Changes
A Media Pack is assigned to the Athlete or team named in the order. It may not be resold. A request to transfer the order to another eligible Athlete or team must be made before the Event and requires Palm N Pixel’s written approval, available capacity, correct replacement information and payment of any price difference. Approval is not guaranteed.
12. Delivery
Final content is expected to be delivered digitally within 1–15 working days after the end of the Event. Working days exclude Saturdays, Sundays and public holidays applicable in Barcelona, Spain.
This delivery window may be extended by force majeure, exceptional production volume, technical recovery, verification needs or circumstances beyond reasonable control. Palm N Pixel will provide a reasonable update if a material delay becomes known.
Delivery is made to the email address or digital destination connected with the order. The Buyer must check spam/junk folders and promptly notify Palm N Pixel if the delivery email is not received.
13. Selection, Editing and Revisions
Palm N Pixel retains professional and creative discretion over selection, sequencing, cropping, colour treatment, stabilization, pacing and other editing decisions. Delivered content is final.
Re-edits, retouching, body or facial alteration, music, alternate crops, alternate reel versions, replacement of subjective selections and other revisions are not included unless expressly stated in the package or separately agreed in writing.
This does not prevent the Buyer from reporting an objectively corrupted, inaccessible or incorrect delivery. Palm N Pixel will investigate a timely, specific report and provide an appropriate remedy where required.
14. Download Links, Storage and File Responsibility
Unless a different period is stated in the delivery message, download links remain active for 30 calendar days from delivery. The Buyer must download the content and create a secure backup during that period.
Palm N Pixel is not responsible for loss after successful delivery, expiry of a clearly communicated download period, deletion from the Buyer’s device, account-access problems or failure by the Buyer to create a backup.
Palm N Pixel may retain production and delivered files for the period stated in Clause 26. Continued availability or later restoration is not guaranteed.
15. Intellectual Property and Buyer Licence
Copyright and all other intellectual-property rights in the photographs, video and edits remain with Palm N Pixel and/or the individual creator where applicable.
Upon full payment and delivery, the Buyer receives a non-exclusive, worldwide, non-transferable licence to download, store, display and share the delivered content for personal and ordinary athlete self-promotion, including posting on the Athlete’s own social media accounts.
Unless the purchased package expressly includes commercial rights, the Buyer may not:
sell, sublicense, license or redistribute the files as stock content;use the content in paid advertising, product packaging or third-party commercial campaigns;remove or misrepresent a visible credit or watermark where one is included;claim authorship of the photography, filming or edit; oruse the content unlawfully, misleadingly, or in a way that infringes another person’s rights.
A sponsor, gym, agency or brand requiring commercial use must obtain the appropriate written licence from Palm N Pixel unless that right is expressly included in the purchased package.
16. Provider and Event Promotional Use
Creating and delivering the purchased Media Pack does not by itself constitute unlimited consent for Palm N Pixel or MC26 to use identifiable content for unrelated advertising.
Palm N Pixel will rely on an appropriate legal basis for any promotional use. Where consent or image authorization is required, it will be requested separately and clearly. Refusing or withdrawing optional promotional consent will not affect delivery of the purchased service.
MC26 may process or use Event imagery under its own event-registration terms, image releases or other legal basis. MC26’s independent processing is governed by its own privacy information.
17. Acceptable Website Use
The Buyer must not misuse the website, attempt unauthorized access, introduce malicious code, interfere with checkout or delivery systems, scrape protected content, impersonate another person or use the service for unlawful activity.
Palm N Pixel makes reasonable efforts to keep website and product information accurate and available, but temporary interruption, maintenance or non-material error may occur. A confirmed order is governed by the information supplied with that order.
18. Force Majeure
Palm N Pixel is not liable for delay or failure caused by events beyond its reasonable control, including severe weather, natural disaster, fire, power or network outage, venue restriction, public-authority action, security incident, labour disruption, epidemic, equipment access restriction, Event cancellation or material Event disruption.
Palm N Pixel will use reasonable efforts to reduce the impact, adapt the service where practical and communicate a material delay or change. This clause does not remove any remedy that mandatory law requires where the contracted service cannot be supplied.
19. Limitation of Liability
To the maximum extent permitted by law, Palm N Pixel is not liable for indirect, incidental, special or consequential loss; loss of profit, opportunity, reputation or anticipated publicity; or loss caused by the Buyer’s failure to follow identification, download or backup instructions.
Subject to mandatory law, Palm N Pixel is not responsible for missed or incomplete coverage caused by obstructed visibility, Athlete positioning, failure to wear the wristband, incorrect information, Event restrictions, third-party interference or live conditions outside its reasonable control.
Where liability may lawfully be limited, Palm N Pixel’s aggregate contractual liability is limited to the amount paid for the affected Media Pack.
Nothing in these Terms excludes or limits liability where exclusion or limitation is prohibited by law, including liability arising from fraud, wilful misconduct, gross negligence, death or personal injury caused by negligence, or the consumer’s mandatory rights relating to total or partial non-performance or defective performance.
20. Complaints and Customer Support
A Buyer who believes that the wrong files were delivered, a file is corrupted, or a material part of the contracted package is missing should contact Palm N Pixel as soon as reasonably possible at the email in Clause 2, providing the order number, Athlete name and a clear description of the issue.
Palm N Pixel will assess the complaint in good faith and provide any correction, replacement, price reduction, refund or other remedy required by applicable law. Statutory complaint rights and limitation periods are not reduced by this operational request.
21. Data Protection and Privacy
Palm N Pixel processes personal data in accordance with Regulation (EU) 2016/679 (“GDPR”), Spanish Organic Law 3/2018 and other applicable data-protection legislation. Clauses 22–31 provide the privacy information for the Media Pack Service.
22. Data Controller
The controller for Palm N Pixel’s Media Pack order, production, delivery and customer-service processing is Palm N Pixel S.L., at the registered office and contact email stated in Clause 2.
Palm N Pixel and MC26 may each act as an independent controller for their own purposes. Where a specific processing activity is carried out under a different controller arrangement, the relevant privacy information will explain that arrangement.
23. Personal Data Collected
Depending on the order and use of the service, Palm N Pixel may process:
the Buyer’s name, email, telephone number, billing details and communications;order, invoice, transaction and payment-status information;the Athlete’s name, athlete number, category/division, team name, lane, heat and schedule;the official Media Coverage Wristband assignment and collection status;photographs, video, voice and other media captured at the Event;customer-support, complaint, consent and authorization records; andwebsite/device data described in the Cookie Policy, where applicable.
Complete card details are ordinarily processed by the payment provider rather than stored by Palm N Pixel. Palm N Pixel does not intentionally collect medical information or other special-category data for this service. Buyers should not send such information unless specifically requested and legally necessary.

Where processing relies on legitimate interests, those interests include coordinating and securing the service, preventing misuse, maintaining evidence of delivery and establishing, exercising or defending legal claims, provided that the individual’s rights do not override those interests.
Where processing relies on consent, consent may be withdrawn at any time without affecting processing lawfully carried out before withdrawal or processing required on another legal basis.
25. Data Provided About Another Person
If the Buyer provides information about another Athlete, the Buyer confirms that the data are accurate, that they are authorized to provide them for the requested service, and that the Athlete has received or will receive this privacy information. Palm N Pixel will provide additional information directly where required by law.
26. Recipients and Service Providers
Personal data may be shared, only as necessary, with:
authorized Palm N Pixel photographers, videographers, editors and administrative personnel;MC26 personnel where needed to verify Athlete identity, accreditation, schedule or operational access;payment, accounting, website, email, cloud-storage, gallery and file-delivery providers;professional advisers, insurers and technical-security providers; andcourts, regulators, law-enforcement bodies or public authorities where legally required.
Processors acting for Palm N Pixel are required to follow appropriate confidentiality and data-protection obligations. Palm N Pixel does not sell or rent personal data.
27. International Transfers
Some technology providers may process data outside the European Economic Area. Where this occurs, Palm N Pixel will use a lawful transfer mechanism, such as an adequacy decision, Standard Contractual Clauses or another safeguard permitted by the GDPR. Information about applicable safeguards may be requested using the privacy contact in Clause 2.
28. Retention
Palm N Pixel applies the following general retention approach:
order, invoice and accounting records: for the period required by tax, accounting and commercial law;contract, delivery, complaint and customer-service records: for the applicable legal limitation period;download links: normally 30 calendar days from delivery unless the delivery message states otherwise;production files and delivered media: normally up to 12 months after delivery, unless earlier deletion is appropriate or longer retention is required for a claim; andcontent retained for optional promotional use: until the purpose ends, the authorization is withdrawn where applicable, or another retention ground expires.
After the relevant period, data will be securely deleted, anonymized or blocked where Spanish law requires restricted retention. Backup copies may persist for a limited technical cycle before secure overwrite.
29. Security and Personal-Data Breaches
Palm N Pixel uses appropriate technical and organizational measures designed to protect personal data against unauthorized access, alteration, disclosure, accidental loss or destruction. Access is limited to people and providers who need it for their responsibilities.
If a personal-data breach occurs, Palm N Pixel will assess the risk and notify the competent supervisory authority and affected individuals where required by the GDPR.
30. Data-Protection Rights
Individuals may exercise the following rights where applicable:
access to personal data and related information;rectification of inaccurate or incomplete data;erasure in the circumstances provided by law;restriction of processing;objection to processing based on legitimate interests and objection to direct marketing;data portability where the legal requirements are met;withdrawal of consent at any time; andthe right not to be subject to a decision based solely on automated processing that produces legal or similarly significant effects, where applicable.
Requests may be sent to the privacy email in Clause 2. Palm N Pixel may request reasonable information to verify identity. Individuals may also lodge a complaint with the Spanish Data Protection Agency (AEPD) at www.aepd.es or with another competent supervisory authority.
Palm N Pixel does not use Media Pack data to make decisions based solely on automated processing that produce legal or similarly significant effects.
31. Minors
Where the Athlete is under 18, the purchase and service must be authorized by a parent or legal guardian. Optional promotional use of identifiable content featuring a minor requires the appropriate separate authorization and will be handled with particular regard for the minor’s rights and interests.
Where consent is the legal basis for data processing, the rules on a minor’s capacity to consent under Spanish law apply; parental or guardian consent is required where the minor cannot validly provide it.
32. Changes to These Terms
Palm N Pixel may update these Terms for future orders to reflect service, legal or operational changes. The version accepted at the time of purchase governs that order, unless a later change is required by law or is expressly accepted by the Buyer.
33. Severability and No Waiver
If a provision is held invalid or unenforceable, it will be applied to the maximum lawful extent and the remaining provisions will continue in effect. A failure or delay in enforcing a provision does not waive the right to enforce it later.
34. Governing Law and Jurisdiction
These Terms are governed by Spanish law. Any dispute will be submitted to the courts competent under applicable law. If the Buyer is a consumer, nothing in this clause removes the protection of mandatory law or the right to bring proceedings before the courts of the consumer’s domicile where applicable.
35. Language
These Terms should be made available in Spanish before contracting where required by law. Any English version is provided for convenience. If both Spanish and English versions are provided and a conflict arises, the Spanish version prevails, without limiting mandatory consumer rights.
36. Final Acknowledgement
By placing an order, the Buyer acknowledges that:
the service is performed under live Event conditions;the purchased package description defines the contracted deliverables;specific moments, movements, results and complete performance recording are not guaranteed;the Athlete must collect and visibly wear the Palm N Pixel Media Coverage Wristband;the cancellation and refund rules in Clause 10 apply, subject to mandatory law;delivery is expected within 1–15 working days after the Event; andthe Buyer has read and accepted these Terms and the privacy information.
Final media will be delivered through a private online gallery within 1–15 working days after the event. The selected package cannot be changed after production has begun unless approved by Palm N Pixel. Submitting this form records the customer’s package request but does not confirm the booking. The booking becomes final only after successful payment and written confirmation from Palm N Pixel.
37. Media Passes and Accreditation
The Provider offers two limited Media Pass categories for Marbella Championship 2026:
All Media Passes are subject to approval and limited availability. They are personal, named, non-transferable, and valid only for their approved purpose. Pass holders must remain within designated media areas and follow all Media Rules and staff instructions.
Access and approved positions may be changed for safety, operational, competition, or official media requirements. Accreditation may be suspended or revoked without refund if any rules are breached, staff instructions are disregarded, or official Event or media operations are disrupted.
