ACKNOWLEDGMENT OF RISKS, PHOTOGRAPHY RELEASE & LIABILITY WAIVER
In consideration of being allowed to participate in ice hockey and hockey-related activities ("Activities") operated by the Sunday Sauce Hockey LLC (the "Host'), the Participant hereby acknowledges and agrees, to the fullest extent permitted by law, as follows:
A) Participation in the Activities involves certain inherent risks. These inherent risks include, but are not limited to, (1) collisions with other players, officials, nets, and/or the boards; (2) lacerations, (3) falling onto the ice, and (4) the risk of injury and/or death resulting from the inherent risks of participation in the Activities, including but not limited to (1) - (4) above. It is understood and acknowledged that injuries and/or death proximately caused by any inherent risk of the Activities may result from the actions or inactions of another player or official, even under circumstances where said player is penalized. Penalties are part of the sport of hockey;
B) The Participant's participation in the Activities is voluntary, and Participant and his/her parent(s) or legal guardian(s) have the opportunity to inspect the Host's equipment and facilities before any participation;
C) The Participant and his/her parents) or legal guardian(s) certify that the Participant has no physical or mental condition that precludes him/her from participating in the Activities and that he/she is not participating against medical advice. The participant is prohibited to be under the influence of alcohol, cannabis (marijuana) or any other mind altering substance during their participation in the above stated Activities;
D) The Participant and his/her parent(s) or legal guardian(s) understand that Participant is obligated to follow the rules of the Activities and can minimize his/her risk of injury by doing so and through the exercise of common sense and by being aware of his/her surroundings;
E) If, while participating in the Activities, the Participant or his/her parents) or legal guardian(s) observe any unusual hazard or condition, which they believe jeopardizes Participant's personal safety or that of others, Participant and/or his/her parents) or legal guardian(s) shall remove Participant from participation in the Activities and immediately bring said hazard or condition to the attention of the Host.
Jersey Return and Replacement
As part of participating, each participant is assigned a team and provided a jersey to be used during that individual skate. The jersey number assigned will be recorded upon receipt of the jersey. Each jersey is to be returned at the completion of each individual pickup skate. It is each individual participant's responsibility to return their assigned jersey. Failure to return a jersey, or any jersey lost or stolen will result in a $85 fee to the person that was assigned the missing jersey.
Photography/Video Release
Participant hereby grants to the Host, its representatives, and employees the right to take photographs/videos of the Participant in connection with the Participant's participation in the Activities. Participant hereby authorizes the Host to copyright, use, and publish the same in print and/or electronically. Participant hereby agrees that the Host may use such photographs of Participant for any lawful purpose, including but not limited to publicity, illustration, advertising, social media and Web content.
Liability Waiver and Hold Harmless
In consideration of being allowed to participate in “Sunday Sauce” private recreational pickup ice hockey skates, I hereby agree to assume full responsibility for any risks, injuries or damages, known or unknown, which I might incur as a result of participating in the Activities.
I further agree to release and hold harmless the Host, the organizers and participants of the game, as well as the owners and operators of the ice rink and its facilities, from any and all claims, liabilities, damages, or expenses that may arise from my participation in the game.
I understand that ice hockey is a physical and demanding sport, and I am fully aware of the risks and dangers associated with participating in the Activities. I am physically fit and have no medical conditions that would prevent me from safely participating in the Activities. I will not be under the influence of any mind altering substances while I participate.
I am voluntarily participating in the Activities and assume all risks associated with it. I understand that this waiver cannot be modified or waived in any way by oral agreement.
By signing this waiver, I acknowledge that I am 18 years of age or older, I have read and understand the terms contained within, and that I am giving up substantial legal rights by agreeing to it. I understand this agreement is binding and there is no expiration date. I acknowledge that I must accurately complete and sign this waiver prior to being allowed to participate in the Activities.
