These Terms of Service (“Terms”) govern your access to and use of the mobile applications and related services operated by Mobile Entertainment Srl (“we,” “us,” or “our”), including Magic Task, Emoji Up, Swipemoji, Mixermoji, DarkShort, and any future apps or services that link to these Terms (collectively, the “Service”). By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.
1. Eligibility (Age Requirements)
Magic Task, Emoji Up, Swipemoji, Mixermoji
You must be at least 13 years old (or the minimum legal age in your country) to use these apps.
DarkShort
The Service is not available to individuals under the age of 16. If you are 16 or older but under the legal age of majority in your country, you may use DarkShort only with the permission of your parent or legal guardian.
You are responsible for ensuring that your use of the Service complies with applicable laws.
2. User Accounts
Some features may require you to create an account. You are responsible for:
Keeping your credentials confidential;
All activity under your account;
Promptly notifying us if you suspect unauthorized access.
Account deletion. If you create an account, you can delete it at any time directly in the app from Settings ▸ Account ▸ Delete account (where available). Upon deletion, we will remove personal data subject to applicable laws and retention obligations.
3. Use of the Service
The Service is provided for personal, non-commercial use. You agree not to:
Use the Service for any illegal or unauthorized purpose;
Copy, record, download, or distribute any content outside of what the apps explicitly allow;
Bypass or attempt to bypass subscriptions, paywalls, geographical limits, or technical restrictions;
Interfere with or disrupt the Service, servers, or networks;
Use bots, scrapers, or automated systems to access or interact with the Service.
All content made available through the Service must be accessed only within our apps.
4. Permissions & Device Access
Some features may request access to device functionality such as the photo library, camera, microphone, or notifications. Access is requested solely to enable the relevant features. You can manage or revoke permissions at any time in your device settings.
5. Subscriptions, Payments & Free Trials
Certain features are available only through a paid subscription.
Billing & Auto-renewal. Payments are charged to your Apple ID or Google Play account. Subscriptions renew automatically unless auto-renew is turned off at least 24 hours before the end of the current period. Your account may be charged for renewal within 24 hours prior to the end of the current period.
Manage or cancel. You can manage or cancel your subscription in your App Store or Google Play account settings.
Free trials. If you start a free trial and do not cancel at least 24 hours before it ends, your trial will automatically convert to a paid subscription. Any unused portion of a free trial will be forfeited when you purchase a subscription.
Price changes. From time to time, subscription prices may change. Apple or Google will notify you and, where required, request your consent before renewal at the higher price; if you do not consent, the subscription will end at the current billing cycle.
Refunds. Refunds for purchases made via the Apple App Store or Google Play Store are handled exclusively by those platforms according to their policies. We do not issue refunds directly.
We do not process or store your payment card details.
6. Intellectual Property
All software, designs, text, graphics, icons, videos, audio, and other materials available through the Service (collectively, “Content”) are the property of Mobile Entertainment Srl or its licensors. Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to use the apps and view Content for your personal, non-commercial use. You may not copy, modify, translate, sell, distribute, or create derivative works from the Content except as expressly permitted within the apps. All rights not expressly granted are reserved.
7. Content Nature & Sensitive Material (DarkShort)
DarkShort may include crime-related narratives and mature themes. Content is provided for entertainment and informational purposes only. It does not promote, instruct, or glorify illegal activity and should not be considered legal, investigative, or educational advice. We may edit, remove, or restrict access to content at any time to comply with laws, platform rules, or our internal standards.
8. Data, Analytics & Third-Party SDKs
We collect limited information to operate, secure, and improve the Service (e.g., device data, crash logs, subscription status, usage analytics). Some apps may integrate third-party SDKs for analytics, performance monitoring, advertising, or crash reporting. These providers operate under their own terms and privacy practices. For details, see our Privacy Policy, available in-app and on our website, which forms part of these Terms.
9. Data Storage & Loss
We do not guarantee permanent storage of any data. Deleting the app, changing devices, or uninstalling without backup may result in data loss.
10. Termination
You may stop using the Service at any time and, where applicable, cancel your subscription via your app store account. We may suspend or terminate access if you violate these Terms, misuse the Service, or if required by law or regulation. Termination may result in loss of access to subscription content without reimbursement, unless required by app store policies or applicable law.
11. Disclaimers
The Service is provided “as is” and “as available.” We do not guarantee that the Service will be uninterrupted, secure, error-free, or that content will always be available or meet your expectations. To the fullest extent permitted by law, we disclaim all warranties, express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
12. Limitation of Liability
To the fullest extent permitted by law, Mobile Entertainment Srl (and its directors, employees, and affiliates) shall not be liable for:
Indirect, incidental, special, consequential, or punitive damages;
Loss of profits, revenue, data, goodwill, or anticipated savings;
Unauthorized access to or use of your account;
Any use of content outside the allowed app environment.
Where liability cannot be excluded, our total liability for any claim arising from or related to the Service or these Terms shall be limited to the amount you paid to us, if any, during the 12 months preceding the event giving rise to the claim. Your sole remedy for dissatisfaction with the Service is to discontinue use.
13. Changes to the Terms
We may update these Terms from time to time. If changes are material, we will notify you via the apps or by other reasonable means. Your continued use after the updated Terms take effect constitutes acceptance. If you do not agree, you must stop using the Service and cancel any active subscription.
14. Apple iOS Terms (EULA Rider)
This Agreement is between you and Mobile Entertainment Srl, not Apple. Your license is non-transferable and limited to using the App on Apple-branded devices you own or control, as permitted by the Apple Media Services Usage Rules (including Family Sharing). Apple has no obligation to provide maintenance or support. To the maximum extent permitted by law, Apple has no warranty obligations; if a paid download fails to conform to any applicable warranty, you may notify Apple and Apple will refund the purchase price. We, not Apple, are responsible for product claims, legal/regulatory compliance, and intellectual-property claims. You represent you are not in an embargoed country and not on any prohibited list. You must comply with any third-party terms applicable to your use of the App. Apple and its subsidiaries are third-party beneficiaries of these terms and may enforce them against you.

15. Governing Law & Jurisdiction
These Terms are governed by the laws of Italy, without regard to conflict-of-law rules. Unless otherwise required by mandatory law, any dispute shall be subject to the exclusive jurisdiction of the courts located in Italy.
