PLEASE READ CAREFULLY. This is a legally binding agreement that voluntarily gives up certain legal rights, including the right to sue Junct·n Studio, LLC for injury, loss, or damage arising from this class.
Section 1 — How This Waiver Is Signed
By completing this form — checking the agreement box and typing your full legal name below — you are creating a binding electronic signature under California Civil Code § 1633.7. This signature covers ONLY the person completing this form.
If you purchased an additional ticket for a friend or guest, that person is NOT covered by your signature. They must read and sign their own copy of this Waiver in person, at the Studio, before class begins. Entry will be denied to any guest without their own signed waiver on file, regardless of ticket purchase status.
Section 2 — Assumption of Risk (Physical Activity)
Strength Sculpt is a physical fitness class involving resistance training, bodyweight movement, and/or equipment-based exercise. I understand this activity carries inherent risk of injury, including but not limited to muscle strain, joint injury, falls, and cardiovascular events. I voluntarily choose to participate with full knowledge of these risks and accept personal responsibility for any injury, loss, or damage I sustain.
Section 3 — Health Representation
I am in good physical health and capable of participating in this class. I understand the instructor and Junct·n Studio staff are not medical professionals and are not responsible for evaluating my fitness to participate. If I have any pre-existing medical condition, injury, or health concern, I have consulted or will consult a licensed physician before participating. I will inform the instructor of any physical limitation before class begins.
Section 4 — Minor Participants (Ages 12–17)
Participants must be at least 12 years old. Any participant under 18 must be accompanied by a parent or legal guardian who remains on the premises for the full class — drop-off attendance is not permitted. A minor may NOT sign this Waiver themselves or via this online form. The parent/legal guardian must sign in person at the Studio on the minor's behalf. A ticket purchase made online for a minor does not satisfy this requirement.
Section 5 — Release & Waiver of Liability
In consideration of being permitted to participate, I, on behalf of myself, my heirs, and next of kin, release, waive, and covenant not to sue Junct·n Studio, LLC, its owners, managers, employees, agents, the instructor (Sophiesstrength_fitness), and the building's landlord (the "Released Parties") from any and all liability, claims, or causes of action arising out of my participation in this class, to the fullest extent permitted under California law. This release does not apply to gross negligence, willful misconduct, or fraud, which cannot be waived under California Civil Code § 1668.
Section 6 — Independent Instructor
Sophiesstrength_fitness is an independent instructor who has rented space from Junct·n Studio, LLC, and is not an employee or agent of Junct·n Studio. Junct·n Studio does not supervise or verify instructor credentials and makes no representation regarding the safety or quality of instruction.
Section 7 — Indemnification & Emergency Medical Treatment
I agree to indemnify and hold harmless the Released Parties from claims arising out of my conduct at this event. In a medical emergency, I authorize Junct·n Studio staff to call emergency services and/or arrange transport at my own expense, and release the Released Parties from liability for good-faith emergency actions.
Section 8 — Photo & Media Consent
By purchasing a ticket and signing this Waiver, I consent to Junct·n Studio photographing and filming the class — including attendees incidentally visible — for marketing and promotional purposes.
Section 9 — Tickets & Refunds
All ticket purchases are final, non-refundable, and non-cancelable regardless of attendance. If Junct·n Studio or the instructor cancels the class, ticket holders will receive a 100% refund — the sole remedy for a canceled class.
Section 10 — Governing Law
This Waiver is governed by California law. Venue for any dispute is Orange County, California. If any provision is held unenforceable, the remaining provisions remain in full force.
I HAVE READ THIS WAIVER IN FULL. I understand its terms and that by signing electronically I am voluntarily giving up legal rights. This form is only for ticket purchasers who are 18 years of age or older, signing for themselves. Guests and minors (ages 12–17) must sign a paper waiver in person at the Studio before entry — see Sections 1 and 4 above.
