(pursuant to Article 10 of the Italian Civil Code and Articles 96 and 97 of Law 633/1941)
Whereas
a) Finproject S.p.A. VAT no.01744770437, with registered office at Via San Gabriele 96, 62010 Morrovalle (MC), (the “Company”) is organizing the following event:
XL EXTRALIGHT® presents AIRSTONE. EXPLORING THE PARADOX OF LIGHTNESS AND MASS, A DIALOGUE BETWEEN PAOLO FERRARINI AND LUCA NICHETTO, that will take place in Milano at Spazio BIG Via Santa Marta 10 on the 23rd of April (the “Event”),
to which you (the “Participant”) will participate;
b) photographic, audio and/or video footage and/or other materials will be taken during the Event, which may include the Participant's images, name, statements and/or voice (the “Material”);
c) this Consent Form has been signed by you through digital means;
the undersigned, as Participant in the Event, hereby declares the following
1. The Participant authorises the Company, throughout the world, in perpetuity and free of charge to use, collect, store, process, modify, alter, transcribe, fix, reproduce, distribute, communicate to the public, transmit, publish and/or disseminate the Materials and/or for the creation of complex and derivative works:
a. by any means and/or system of transmission and dissemination existing now or invented in the future;
b. using any method of transmission, broadcasting and reception, whether now or hereafter invented; and
c. in any form or manner; and
d. using any technology and protocol now or hereafter developed;
e. for reception at any terminal, even if not currently in existence.
2. The Participant acknowledges, and to this end authorises the Company, the use of the Materials for the following purposes:
a. Non commercial: institutional activities and non-commercial communications on the Company’s channels.
b. Commercial and/or promotional: advertising, newsletters, online media campaigns and posts on the Company’s web site and social media.
3. The Participant acknowledges, and for this purpose authorises the Company, that the Materials shall be used internally and externally to the Eni Group.
4. The Participant acknowledges, and to this end authorises the Company, that the Materials may be transferred to, or otherwise used also by, the following subjects (without the Participant receiving any compensation, indemnity or reimbursement):
a. Companies inside Eni Group;
b. Third Parties outside Eni Group and specifically: companies that provide support services for the organization and management of the Event; photographers, video editing service providers, marketing consultants, designers, pr; companies providing IT services, Xister Reply S.r.l. and Damn S.r.l. (e.g. xlextralight.com finproject.com shop.nichetto.com @14septembre @barbatibertolissi @nichettostudio @lucanichetto @damnstudio @matteoragnistudio @theinstalosopher @paoloferrarini_).
5. The Participant declares and warrants that he/she/they is free to give his/her/their consent as set out in this Consent Form and undertakes to indemnify and hold the Company harmless from any damage, prejudice, cost, expense (including legal fees), penalty or any other charge arising from any claim or action, whether judicial, arbitral or administrative, by any third party, including public administrations, national or international, arising out of a breach of the representations made by the Participant under this Consent Form.
6. The Participant also acknowledges that the Company is not liable for damages to the Participant's person or property occurring during the Event and the collection of Materials, except in cases of willful misconduct or gross negligence of the Company. The Participant undertakes to respect any instructions, recommendations or indications provided during and for participation in the Event.
7. The Participant acknowledges that the consent given is free of charge and furthermore renounces any mention on the occasion of the exploitation of the Materials and/or derivative works by the Company and/or its eventual assignees and expressly renounces to bring any action against the aforementioned parties in order to claim payment or otherwise, for such past, present or future use.
8. The Participant has received the privacy policy with information regarding the processing of personal data, including the Materials, to which this Consent Form is attached.
9. This Consent Form is governed by Italian law, with the exclusion of the rules of private international law. Any dispute relating to this Consent Form shall be submitted to the exclusive jurisdiction of the Court of Milan.
