Participant Registration, Waiver, and Liability ReleasePlease read this document carefully. By completing this registration and checking the agreement box, you are waiving certain legal rights for yourself and/or your minor child.
1. Risk Assumption and Release of LiabilityFor and in consideration of the undersigned participant’s registration with Pinnacle Volleyball Hawaii LLC ("Organization") and being allowed to participate in events and member activities, the participant and their parent(s) or legal guardian(s) hereby wave, release, and relinquish any and all claims for liability and causes of action.
This includes, but is not limited to, claims for:
Personal injury, partial or total disability, paralysis, or death.
Property damage or wrongful death occurring to the participant or parent/guardian.
This release applies to any injuries or damages arising out of participation in events, sports, or activities incidental thereto, whenever or however they occur. This agreement binds the participant, parents/guardians, and their heirs, executors, administrators, and assigns.
2. Knowledge of inherent RisksThe participant and parent(s)/guardian(s) acknowledge and understand that volleyball and related training involve inherent risks of severe bodily injury. These risks may be caused by:
The negligence of the participant or parent(s)/guardian(s).
The negligence of others, including the Organization, its affiliates, members, event hosts, coaches, officials, sponsors, advertisers, or owners/operators of the premises (collectively referred to as "Releasees").
The conditions and maintenance of the facilities, equipment, and related premises.
Risks and dangers not known to us or not reasonably foreseeable at this time.
The scope of this waiver explicitly includes any cause of action based on negligence arising from the performance, or failure to perform, maintenance, inspection, supervision, instruction, or control of said areas, or the failure to warn of dangerous conditions. If any claim for personal injury or wrongful death is commenced against Releasees, the participant and/or parent/guardian agree to defend, indemnify, and hold harmless the Releasees from any losses or costs.
3. Consent to Medical Treatment of a MinorI hereby give my consent to have the registered participant treated by a physician, surgeon, or emergency medical personnel in case of sudden illness or injury during an event.
I understand that the Organization provides no medical insurance for such treatment under its liability insurance coverage. Medical benefits for treatments/injuries are the sole responsibility of the participant or parent/guardian, unless separate medical coverage has been verified and purchased through the Organization.
4. Photo and Media ReleaseThe Organization reserves the right to photograph and record video of facilities, activities, and program participants for potential future use. All photos and media remain the property of the Organization and may be used for publicity, marketing, and promotional purposes.
