Liability Waiver
I am voluntarily participating in physical exercise that can be strenuous and subject to risk of serious injury. Redfern Run Club urges you to obtain a physical examination from a doctor before beginning any exercise or training program. By participating in Redfern Run Club sessions, you agree that participation is entirely at your own risk.
I recognise that exercise is not without risk to the musculoskeletal system (e.g. sprain, strain) and cardiorespiratory system (e.g. dizziness, fainting, abnormal heartbeat, discomfort in breathing, abnormal blood pressure response, and in rare instances, heart attack or stroke). I further acknowledge that sessions take place on public roads and shared paths, which carry additional inherent risks including traffic and uneven terrain. I acknowledge that not all risks can be known in advance.
I HEREBY, for myself, my heirs, executors, administrators, assigns, or personal representatives (hereinafter collectively "Releasor", "I" or "me", which terms shall also include the Releasor's parents or guardian if the Releasor is under 18 years of age), knowingly and voluntarily enter into this WAIVER AND RELEASE OF LIABILITY and hereby waive any and all rights, claims or causes of action of any kind arising out of my participation in Redfern Run Club activities.
I HEREBY release and forever discharge Redfern Run Club and its facilitators, partners, agents, staff, volunteers, representatives, predecessors, successors and assigns (collectively "Releasees"), from any physical or psychological injury that I may suffer as a direct result of my participation in any Redfern Run Club session.
I FURTHER AGREE to indemnify, defend and hold harmless the Releasees against any and all claims, suits or actions of any kind whatsoever for liability, damages, compensation or otherwise brought by me or anyone on my behalf, including any related costs.
I FURTHER ACKNOWLEDGE that Releasees are not responsible for errors, omissions, acts or failures to act of any party or entity conducting a specific event or activity on behalf of Releasees. In the event that I require medical care or treatment, I authorise Redfern Run Club and its facilitators to provide all emergency medical care deemed necessary, including but not limited to first aid, CPR, use of AEDs, emergency medical transport, and sharing of medical information with medical personnel.
I agree to assume all costs involved and accept financial responsibility for any costs incurred as a result of such treatment. I am aware that I should carry my own health insurance. In the event that any damage to equipment or facilities occurs as a result of my wilful actions, neglect or recklessness, I acknowledge and agree to be held liable for all associated costs.
Both participant and Redfern Run Club agree that this agreement is clear and unambiguous as to its terms, and that it will be interpreted based on the language in accordance with the purposes for which it is entered into.
Insurance
Redfern Run Club holds Public Liability Insurance with cover up to $20,000,000 per incident, covering all club-managed sessions. Participants are encouraged to maintain their own personal health insurance.
Road Safety Acknowledgement
I acknowledge that Redfern Run Club sessions take place on public roads and shared paths in and around the Redfern and South Eveleigh area. I agree to obey all road rules and traffic signals at all times, run on footpaths where available and on the left-hand side of the road where footpaths are not present, follow all safety instructions provided by the facilitator, and inform the facilitator of any injury, illness or concern before or during a session.
Photography & Media Consent
By signing this form, I consent to the use of any photographic or video image of myself taken by an authorised photographer or videographer of Redfern Run Club, in their social media, advertising and promotional materials for all future purposes of promoting Redfern Run Club.
Your personal information will be collected and stored securely, used only for club administration and emergency purposes, and will not be shared with third parties without your consent.
Declaration
By submitting this form, I confirm that I have read and understood this waiver in full, that I am 18 years of age or older (or have obtained parental/guardian consent), that all information provided is accurate and complete, and that I agree to be bound by all terms set out above.
