Short term rental agreement

The following agreement is between the host and guest(s) as of the date last set forth on the signature page of this Agreement. For good and valuable consideration, the sufficiency of which is acknowledged, the parties hereby agree as follows:

1. Property

The short term rental property is located at the stated street address.

2. Maximum occupancy

The maximum number of guests is limited to agreed number of guests.

3. Term of the lease

The short term rental begins on the stay start date and ends on stay end date.

Rent is charged per night, and is exclusive of the morning of the end day, as this averages to a full day with the evening move-in on the start day.

4. Access

The guest(s) shall allow the emergency contact access to the property for purposes of repair, inspection or emergency. The emergency contact shall exercise this right of access in a reasonable manner by giving at least 24 hours notice (unless in case of emergency).

5. Security deposit

A security deposit is due prior to the start date to finalise the stay. The security deposit is paid via bank transfer to Homees App.

The deposit is for security purposes and will be refunded within 7 days provided no deductions are made due to:

i. damage caused to the property or furnishings;

ii. dirt or other mess requiring excessive cleaning; or

iii. any other cost incurred by Host due to Guest's stay

6. Cancellation policy

In the event of a cancellation, homees will be entitled to receive AUD $100 out of the security deposit to cover their time in processing the match.

In the event of cancellation at least 14 days before the move-in date under this short-term rental agreement, the host will be entitled to retain a portion of the security deposit equivalent to 1 week of the weekly rent amount (minus $100).

In the event of cancellation 7 days or fewer before the start date under this short-term rental agreement, the lister will be entitled to retain a portion of the security deposit equivalent to 2 week's of the weekly rent amount (minus $100).

After the start date, in the event of cancellation or failure to pay rent under this short-term rental agreement, the security deposit will be retained by host.

The host reserves the right to use the security deposit to cover unpaid rent, damages, or costs associated with finding a replacement tenant. The host will make reasonable efforts to mitigate losses by seeking a replacement tenant, and if successful, the security deposit may be adjusted accordingly. Upon fulfilling all rental obligations, the security deposit or remaining portion will be refunded to the tenant following a property inspection.

7. Payment

The first week's rental payment is to be made at least 3 days before the start date.

Rent is made by bank transfer to homees bank account.

Payment is due weekly on the day rent is to be paid. Late payment will result in a dishonour fee of $10, deducted from the security deposit at the end of the stay.
