• and exclusively entitles
- the customers listed on the first page of the guarantee certificate who have acquired the PREFA Product directly from PREFA or from a specialist company authorized to install the PREFA Product (the "PREFA Roofer") as the end consumer,
- and the customer's legal successor of ownership of the building.
Protection of the customer covered by the Guarantee is subject to the following requirements, conditions, and limitations:
1. The PREFA Product covered by the Guarantee is manufactured from aluminum, which, at the time of manufacture, complies with the following standard:
• Coil-coated aluminum: EN 1396:2015.
2. The duration of the Guarantee ("Guarantee Period"¹) shall start from the date of invoice issued by the PREFA Roofer to the purchaser of the PREFA product.
2.1. The Guarantee Period for the colour coating is reduced to 10 years or 25 years for P.10 quality if the building is located in a coastal area.² Here, the term "coastal area" indicates a section of 0 to 1,500 m from the coastline towards the inland area.
2.2. The Guarantee Period for the colour coating shall be reduced by half if the PREFA Product is installed in the area between the "Horse latitudes" (30 degrees north and south of the equator). If the building is also located in a coastal area, PREFA shall only guarantee the colour coating for the duration of half of the Guarantee Period specified in 2.1.
3. PREFA guarantees that, during the Guarantee Period:
• The basic material of the PREFA Product will not exhibit any changes as a result of cracks, corrosion (rust) or frost which could impede the PREFA Product's mechanical functionality;
• The colour coating of the PREFA Product will not peel, blister, splinter, crack or break (with the exception of tiny cracks or tears which may result at the cutting points of the products as a result of installation or processing or for production-related reasons).
4. Requirements to be fulfilled for the Guarantee to apply:
• The professional installation of the PREFA product by a duly authorized specialist company, in accordance with PREFA's installation guidelines and mounting instructions, applicable at the time of mounting or installation; the only authorized specialist company is the PREFA Roofer;
• The exclusive use of original PREFA accessories during mounting or installation;
• The installation of the PREFA Product in environments that are suitable, in accordance with EN 1396:2015, Table C.1, categories 1 to 3 (including 4b);
• An existing guarantee certificate issued by PREFA not more than one year after the date of invoice described in point 2.
The Guarantee on the colour coating only applies to the original colour coating on the outer side of the PREFA Product and not to any re-coated or touched-up surfaces.
5. Excluded from the Guarantee shall be any damage caused to the PREFA Product's basic material and/or coating:
• As a result of mounting or installing the PREFA Product contrary to the aforementioned conditions;
• As a result of natural disasters, floods or other cases of force majeure or intermittent or continuous immersion of the PREFA Product in water or other liquid or solid media;
• As a result of the pressure of snow or ice, or as a result of hail or lightning (particularly deformations);
• As a result of wear and tear (in particular, changes in the shade or gloss level);
• As a result of installing the PREFA Product in areas with a corrosive atmosphere (e.g., in areas with chemical fumes or salt spray) — this only applies if no alternative is defined in the guarantee;
• As a result of other (electro-) chemical reactions with the environment or other building materials;
• As a result of incorrect further processing of the PREFA Product;
• As a result of the use of unsuitable cleaning products or cleaning methods;
• As a result of factors damaging the PREFA Product's basic material or colour coating which can be attributed to the building site, or during storage at the building site or otherwise prior to installing the PREFA Product;
• As a result of mechanical or other physical damage to the PREFA Product caused by external forces of any kind;
• As well as damage covered by an insurance policy and damage to material replaced under this Guarantee.
6. NOTE: The Guarantee only covers damage to the PREFA Product's basic material or colour coating which arises during the Guarantee Period and is reported to PREFA in writing by the customer within 30 days after the point at which the customer first noticed, or could have noticed, the case for the guarantee claim (upon presentation of the Guarantee).
7. If the guarantee claim proves to be justified, PREFA shall, at its own discretion:
• Repair the basic material or colour coating by restoring it,
• or supply, free of charge, a replacement PREFA Product if the basic material or colour coating is damaged, delivering this to the Roofer commissioned with the mounting or installation (or, alternatively, to the Roofer nearest to the customer). Any assembly or disassembly costs must be borne by the customer.
PREFA shall reserve the right to alter or modify the way in which PREFA Products and/or colour coating of PREFA Products are produced at any time. If, for this reason, the PREFA Product to be replaced or the colour required for the new coating is no longer available, PREFA shall, at its own discretion, use a Product or colour coating of a similar quality. If a PREFA Product has been repaired or replaced, the remaining part of the Guarantee Period applying to the originally-installed product shall apply to this product. The costs of repairing or replacing a defectively-installed PREFA Product and the replacement of the same with new coating do not represent a defect covered by the Guarantee. Consequential damage and all other damage resulting from the damaged basic material or damaged colour coating shall not be replaced by PREFA.
8. The Guarantee does not limit the customer's rights with regard to the specialist company commissioned with the mounting or installation of, or the distributor from whom it purchased, the PREFA Product.
9. The Guarantee shall be exclusively governed by Austrian law. The place of jurisdiction for claims under the Guarantee shall be PREFA's registered office in Austria.•
