Piles Ranch Visitor Waiver, Agreement & Release of Liability Form

As a condition to visiting and entering onto property located at 28518 Leonard Road, Centertown, Missouri 65023 (hereinafter referred to as “Piles Ranch”), the signatory below executes and delivers this release and waiver. I fully understand that by signing this agreement, I waive, release, and relinquish, any and all right to seek the recovery of damages for any personal injury, property damage, other cause of action, known or unknown, which may arise from my entry onto Piles Ranch and activities associated therewith.
I, _______________________________, hereby sign this agreement on behalf of myself, my child, my personal representatives, heirs and assigns,_____________________. I acknowledge and understand that Piles Ranch is a working farm and activities at the farm include serious risk or harm. I understand I may be exposed, including but not limited to: wildlife, farm animals, insects, inclement weather, heavy machinery, tools, farm equipment, electric fencing, holes in the ground and negligence of employees or volunteers. I understand that is not inclusive of all possible risks all of which may involve personal injury/illness, death, or damage to property. I agree that I will obey all signs, warnings, and instructions from my guide while at Piles Ranch. In the event that any damage to livestock, equipment, fencing, gates, or any facilities occurs as a result of my or my families’ willful actions, negligence, or recklessness, I acknowledge and agree to be held liable for any and all costs associated with any actions or negligence. I agree this waiver shall be interpreted broadly and inclusively as Missouri state law permits. In the event that any clause in this provision be held invalid by any court or competent jurisdiction, the invalidity of a clause shall not otherwise affect the remaining provisions of this waiver and it shall continue to be enforceable. If I do not follow the instructions at Piles Ranch, I may be asked to leave the property without refund.
Assumption of Risk: I willingly and knowingly release Piles Ranch and its officers, owners, landowners, photographers, and agents from any and all liability. I agree to assume all risks and responsibilities in my participation. I understand I shall be solely responsible for any medical or any other costs arising from injury or damage. I agree that I will not file litigation against Piles Ranch, owners, land owners, employees, volunteers, or agents for any liability including accident, injury, theft, property damage, and the like.
Release of Liability: I hereby release and discharge Piles Ranch, its owners, employees, and affiliates from any and all liability, claims, demands, actions, or causes of action whatsoever arising out of or related to any loss, damage, or injury, including death, that may be sustained by me (or the minor participant for whom I am the guardian), whether caused by the negligence of the farm or otherwise, while participating in agritourism activities.
Medical Authorization: I agree that I am physically and mentally fit to participate in activities at Piles Ranch. I understand that there are no medical services available on site. Additionally, there are no restrooms on site. I give permission to Piles Ranch to authorize emergency medical treatment for me. I release Piles Ranch and its officers, land owners, employees, volunteers, photographers, and agents for any liability arising to injury, damage, or death.
Photo/Video Release: I grant permission to Piles Ranch to use any photographs or videos taken of me (or the minor participant for whom I am the guardian) during the activities for promotional purposes. Indemnification: I agree to indemnify and hold harmless Piles Ranch], its owners, employees, and affiliates from any claims, damages, or expenses arising out of my (or the minor participant's) actions or negligence.
Other Events; During my event, I may be up close and near livestock including animals with horns. I agree to follow all signs, warnings, and instructions. I agree to follow all directions given by Piles Ranch. I also acknowledge that the terrain could be rough and I must be careful of holes, fencing, gates, and the like. Additionally, there is electric fencing on the property. Children under the age of eighteen (18) years old must be accompanied by a parent or guardian. Parents or guardians shall be responsible for their children at all times. I agree not to run, jump, yell, hit, grab, or the like at any animals. This is their home.
