Individual Coaching Agreement

This agreement is between R Dr. Locatelli Roberta, Im Winkelrain 18, 72076 Tübingen, Germany (the coach) and the Client:

1. Description of Coaching

Coaching is a thinking partnership between Coach and Client in a creative process that supports and inspires the Client to maximize their personal and professional potential. ADHD Coaching addresses the specific needs of clients who have been identified as ADHD,  or experience ADHD-like traits.

2. The Coach commits to:

- provide an honest, non-judgmental, and supportive service to the Client at all times.
- maintain the ethics and standards of behaviour established by the International Coach Federation (ICF) and the Professional Association for ADHD Coaches (PAAC) of which the Coach is a member: see coachfederation.org/ethics and https://paaccoaches.org/ethics/ and https://www.divergentempowerment.com/standards
- manage the boundaries of the coaching relationship

3. The Client commits to:

- communicate honestly and take responsibility for creating and implementing their own decisions, choices, actions, and results
- review the ICF Code of Ethics and applicable standards of behaviour coachfederation.org/ethics
- create the time and energy to participate fully in the program

4. Coach and Client commits to:

- adhere to the coaching agreement
- be open and honest about what works or doesn’t work in the relationship and seek appropriate solutions
- evaluate the coaching process and progress against goals

5. Coaching Boundaries

Coaching is not psychological counselling or any type of psychotherapy, nor can it substitute professional legal, medical, or financial advice.

If the Client is currently under the care of a mental health professional, it is recommended that the Client inform the care provider of the nature and extent of the coaching relationship agreed upon by the Client and the Coach.

The Client is solely responsible for creating and implementing their own physical, mental, and emotional well-being, as well as for any decisions, choices, actions. As such, the Client agrees that the Coach is not and will not be liable or responsible for any actions or inaction, or for any direct or indirect result of any services provided by the Coach.


The Client acknowledges that coaching is a comprehensive process that may involve different areas of his or her life, including work, finances, health, relationships, education and recreation. The Client agrees that deciding how to handle these issues, incorporating coaching principles into those areas and implementing choices is exclusively the Client’s responsibility.

6. Services

The parties agree to engage in a Coaching Programme delivered through online meetings. The Client selects a Package from those offered by the Coach at the time of booking, and the number of sessions, duration, and payment terms of that Package are as set out in the Coach's current pricing information, which forms part of this Agreement.

Where a Package is paid in instalments, the instalments function as a subscription: payments will be automatically billed every month, irrespective of the frequency of sessions, unless a special agreement has been reached, as detailed in Section 12.

Where a Package allows for extension beyond its original length, this may be agreed between Client and Coach at the pricing and terms applicable at the time of extension.

The validity of this coaching agreement starts on the day the client accepts this coaching agreement.

The sessions are 60 minutes long. If rates change before this agreement has been signed and accepted, the prevailing rates will apply.

The Coach may also be available for additional time, per Client’s request, on a basis rate of 105 euros/hour (this might include, for example, reviewing documents, reading or writing reports, engaging in other related services outside of coaching hours).

The time of the coaching meetings will be determined by the Coach and the Client based on a mutually agreed-upon time. The Client will join the Coach via Zoom. The URL will be provided by the Coach prior to each session.

Between sessions, the Coach may send check-in emails as part of the accountability structure of the Programme. The Client is welcome to reply to these, or to email the Coach directly, to share a success, flag a problem, or ask a question. The Coach will read all messages and reply briefly whenever possible and appropriate. The Coach will reserve fuller discussion, problem-solving, or perspective-sharing for the next session. Email support between sessions is not a substitute for coaching sessions and is offered at the Coach's discretion.

7. Confidentiality

This coaching relationship, as well as all information (documented or verbal) that the Client shares with the Coach as part of this relationship, is bound by the principles of confidentiality outlined in the ICF Code of Ethics.

-The Coach will not divulge that the Coach and Client are in a coaching relationship without the express consent of the Client.

The Client is, of course, free to discuss the coaching relationship with anyone at any time.

- The Coach will not disclose any confidential information pertaining to the Client without the Client’s express consent.

8. Privacy and Release of Information

Confidential Information does not include information that:

(a) was in the Coach’s possession prior to its being furnished by the Client;

(b) is generally known to the public or in the Client’s industry;

(c) is obtained by the Coach from a third party, without breach of any obligation to the Client;

(d) is independently developed by the Coach without use of or reference to the Client’s confidential information; or

(e) the Coach is required by statute, lawfully issued subpoena, or by court order to disclose;

(f) is disclosed to the Coach and as a result of such disclosure the Coach reasonably believes there to be an imminent or likely risk of danger or harm to the Client or others; and

(g) involves illegal activity.

The Client also acknowledges his or her continuing obligation to raise any confidentiality questions or concerns with the Coach in a timely manner.

According to the ethics of our profession, topics may be anonymously and hypothetically shared with other coaching professionals for training, supervision, mentoring, evaluation, and for coach professional development and/or consultation purposes.

Additionally, the Coach holds credentials through the International Coaches Federation (ICF) and the Professional Association of ADHD Coaches (PAAC). An ICF and PAAC credential are the most advanced and prestigious distinctions that can be earned by a member of the coaching profession. One requirement to earn and upgrade this credential is to provide proof that the coach has a certain number of client coaching hours. This proof is provided in the form of a client coaching log that lists the client’s name, contact information and hours coached. There is never any disclosure of coaching content in this log. The Coach is committed to protecting the Client’s privacy.
Client information will not be disclosed, sold or traded to any outside parties.
The Client has the right to be informed about how personal information is being used, to access the personal information held about the Client and to ask that personal information be corrected, updated or deleted. The Client may exercise their rights of access, rectification, cancellation and opposition by contacting the Coach by email at roberta@divergentempowerment.com with the subject 'PRIVACY'.

9. Consent to Pass Contact Details to ICF and PAAC

By signing this document, the Client agrees to permit their contact information (email address or phone number only), coaching start and end dates to be shared with the International Coaching Federation (ICF), Professional Association for ADHD Coaches (PAAC) if requested for the sole and necessary purpose of verifying the coaching relationship to support the coach’s accreditation.

10. Session Cancellation Policy

It is the Client's responsibility to notify the Coach 24 hours in advance of the scheduled calls/meetings. Coach reserves the right to bill Client for any missed meeting without a 24-hour notice cancellation. Coach will attempt in good faith to reschedule the missed meeting.

11. Coach Unavailability

In the event that the Coach is temporarily unable to conduct scheduled sessions due to illness, personal emergency, or other unforeseen circumstances, the Coach will notify the Client as soon as reasonably practicable. Coach will attempt in good faith to reschedule the missed meeting as soon as possible.

If the Coach anticipates being unavailable for a period exceeding four consecutive weeks, the Coach will notify the Client in writing and offer the following options: (1) pause the coaching relationship at no cost until the Coach resumes services, with the validity period for any outstanding session package extended accordingly, or (2) terminate the Agreement with a refund for any unused sessions.

12. Completion Window

Once the Client has subscribed to a Coaching Package, they have until the number of months it would take to complete the Package at a pace of three sessions per month, plus an additional three months, to complete all sessions. The Coach will attempt in good faith to schedule or reschedule all paid sessions within this period. Where the Client pays for the Package in instalments rather than as a one-time payment, instalments will continue to be due monthly regardless of how frequently sessions are scheduled or attended, except where a pause has been agreed as set out below.

In exceptional circumstances due to hardship, illness, or other unforeseeable circumstances, the Client may request to pause the Package temporarily, under the same notice requirements as set out in Termination below. Where a pause is agreed, instalment payments will also pause for the duration, and the completion deadline set out above will be extended accordingly.

13. Termination

The Client may request to discontinue the Package before all sessions are completed, provided they notify the Coach and explain their reasons for doing so at least 10 days before the next instalment is due. Where such a request is made, the Coach and Client will agree on the resulting arrangement, which may include ending the Client's obligation to pay further instalments.

Where the Client does not make a request to discontinue, and instead stops responding or cooperating in arranging sessions, this will not release the Client from their obligation to pay any outstanding instalments for the Package, and any unfulfilled session will be considered missed and forfeited, with no entitlement to a refund.

14. Force Majeure

Neither party shall be liable for any failure or delay in performing their obligations under this Agreement where such failure or delay results from circumstances that could not have been reasonably anticipated or prevented. In such circumstances, the affected party will notify the other party as soon as practicable, and the parties will work together in good faith to determine an appropriate course of action, which may include pausing or terminating the Agreement.

15. Right of Withdrawal (Widerrufsrecht)

You have the right to withdraw from this contract within fourteen days without giving any reason. To exercise your right of withdrawal, you must inform the Coach of your decision to withdraw from this contract by means of a clear statement (e.g., a letter sent by post or email). You may use the model withdrawal form below, but it is not obligatory.

To meet the withdrawal deadline, it is sufficient for you to send your communication concerning the exercise of your right of withdrawal before the withdrawal period has expired.


If you withdraw from this contract within these terms, the Coach shall reimburse all payments they have received from you, without undue delay and in any event not later than 14 days from the day on which we are informed of your decision to withdraw from this contract. The Coach will carry out such reimbursement using the same means of payment as you used for the initial transaction, unless you have expressly agreed otherwise; in any event, you will not incur any fees as a result of such reimbursement.

16. Governing Law

This Agreement is governed by the laws of the Federal Republic of Germany. This does not affect any mandatory consumer protection rights the Client may have under the law of their country of residence, where applicable
